The latter are traditionally described as rights possessing a positive status or, simply, positive rights, which in the form of cultural, economic and social rights complement the basic catalogue of human rights and basic freedoms and, unlike so called negative rights, fore and foremost call upon the legislative action of the state or the legislator concerning their successful implementation. Historically, the catalogue of human rights and basic freedoms, in Europe embodied in the form of the European Convention on Human Rights (ECHR), first consisted of civil and political rights, which do not in itself represent a sufficient legal framework for the protection of personal dignity, one’s private autonomy, etc. Following the theme of the special issue, the authors thus focus on the role of the European Social Charter (ESC) in protecting and offering effective implementation of the human right to social security and other basic social rights. Choosing the Charter for its position as the central international human rights document in the field in Europe, the authors showcase how basic social rights, together with the human right to social security, can become successfully implemented and protected at the level of international law even if facing the burdens stemming from their affiliation to the second generation of human rights. However, it is often exactly the ECHR that offers such protection and means of effective implementation</dc:description><dc:description xml:lang="sl">Avtorja v prispevku obravnavata pravno naravo temeljnih socialnih pravic oziroma pravno naravo človekove pravice do socialne varnosti kot ene osrednjih človekovih pravic t. i. druge generacije. Te so tradicionalno opredeljene kot t. i. pravice pozitivnega statusa, ki v podobi ekonomskih, socialnih in kulturnih pravic dopolnjujejo osrednji katalog človekovih pravic in temeljnih svoboščin ter drugače od t. i. obrambnih pravic ali pravic negativnega statusa oziroma pravic prve generacije glede njihovega učinkovitega uresničevanja v prvi vrsti terjajo aktivno ravnanje države oziroma zakonodajalca. Katalog človekovih pravic in temeljnih svoboščin, ki ga v Evropi uteleša Evropska Konvencija o varstvu človekovih pravic (EKČP), je historično v prvi vrsti sicer določen z državljanskimi in političnimi pravicami, ki pa same po sebi ne predstavljajo zadostnega pravnega okvirja za varstvo posameznikovega osebnega dostojanstva, zasebne avtonomije, ipd. V luči posebne številke se prispevek tako osredotoča na pomen Evropske socialne listine (ESL) kot osrednjega mednarodnega pravnega akta s področja temeljnih socialnih pravic v Evropi pri uresničevanju ali varstvu človekove pravice do socialne varnosti in drugih temeljnih socialnih pravic.
