It is noticeable that national courts increasingly recognise legal standing to individuals for bringing their claims, while there is also an emerging trend of recognising positive obligations of states for ensuring human rights, which demand from them active engagement in environmental problems, including climate change. When plaintiffs fail to succeed before domestic courts, and the state is a party to treaties recognising a possibility of bringing individual communications to committees as monitoring bodies established on the basis of such treaties, the individuals increasingly, in spite of the length of procedures, decide to initiate international proceedings against the state. The article also illuminates the pertinent practice of the Human Rights Committee</dc:description><dc:description xml:lang="sl">Članek obravnava razvijajočo se prakso domačih sodišč in mednarodnih pogodbenih teles na področju človekovih pravic, pri čemer pritožniki navajajo kršitve človekovih pravic zaradi okoljskih sprememb, posebej glede na podnebne spremembe. Opaziti je, da domača sodišča vse pogosteje priznavajo pravni interes posameznikom za tovrstne tožbe, trend pa gre tudi v smeri prepoznavanja odgovornosti držav za izpolnjevanje pozitivnih obveznosti zagotavljanja človekovih pravic, ki od držav zahtevajo aktivno obravnavanje okoljske problematike, vključno s podnebnimi spremembami. Ko domača sodišča pritožnikom ne ugodijo, država pa je pogodbenica mednarodnih pogodb, ki posameznikom omogočajo pritožbo na odbore kot nadzorne mehanizme, ki so ustanovljeni na njihovi podlagi, se posamezniki kljub dolgotrajnosti postopka vse pogosteje odločajo tudi za postopek proti državi na mednarodni ravni.
