First, the article offers an overview of the energy sector in the context of EU State aid rules, and beyond. This is followed by a presentation of the EU legal framework on State aid. Typical examples of State aid in the energy sector are then highlighted. The article proceeds with a general outline of the rights and obligations of the Member States, recipients of State aid, and other stakeholders. Subsequently, the (national) procedures for enforcement of EU State aid rules are presented. The article concludes with a final reflection, emphasising the significance of EU State aid rules for the energy sector, particularly for the recipient of State aid, who, in addition to the potential benefits of receiving such aid, also bears the greatest risk in cases where the State aid is granted in breach of EU rules. Given the strategic significance of the energy sector, (financial) distress experienced by a beneficiary of State aid will, sooner or later, have adverse implications for entities that are economically or operationally interconnected (spill-over effect). In this context, the author underscores the importance of conducting internal assessments to determine the legality of transactions that may constitute State aid. Najprej je predstavljen energetski sektor v kontekstu pravil EU o državni pomoči skupaj s temi pravili. Nato so opisani tipični primeri državnih pomoči v energetskem sektorju. Sledi splošna predstavitev pravic in obveznosti države članice, prejemnikov državnih pomoči in drugih deležnikov. Za tem so predstavljeni (nacionalni) postopki za izvajanje pravil EU o državni pomoči. Prispevek se zaključi s sklepom, v katerem je poudarjen pomen pravil EU o državni pomoči za energetski sektor, zlasti pa za prejemnika državne pomoči, ki poleg potencialnih koristi prejete državne pomoči nosi tudi največje tveganje, če prejme državno pomoč v nasprotju s pravili EU. Glede na pomen energetskega sektorja težave prejemnika državne pomoči prej ali slej pomenijo tudi težave za tiste, ki so z njim povezani. Avtor glede tega svetuje vsakokratno notranjo presojo dopustnosti transakcij, ki bi lahko bile državna pomoč.
