In conformity with the Recommendation of the Parliamentary Assembly of the Council of Europe no. 1557 from 2002 concerning the legal status of Roma in some European states, the author strives for Roma to be acknowledged the status of national minority in every state they inhabit, and to be given individual and collective minority rights. The article focuses on the stipulations of two special laws on minority protection, adopted in Serbiaand Montenegro (2002) and Poland (2005). Having been subject to unfavourable historical situation and negative attitudes on the part of majority populations, Roma continue to live in unfavourable social conditions and are still victims of marginalization and prejudice. That is why the documents treat them as a threatened/vulnerable community which has to be given the chance of social integration. In 2004 legal experts in EU even proposed a special Directive on social integration of Roma. The question is whether legal treatment of Roma as a socially vulnerable community offers sufficient basis for the implementation of this goal, because it might be just another pragmatic solution which fails to deal with the essential developmental issues and does not try to alter the relations of power within the existing political structuresAvtorica obravnava nekatere značilnosti urejanja položaja romske skupnosti v mednarodnih dokumentih in v sprejeti notranji zakonodaji posameznih držav, zlasti glede poimenovanja in definicije, pravnega statusa in opredelitve posebnih ukrepov varstva romske skupnosti. Osrednje mesto med vprašanji, ki opredeljujejo različne pristope k nadaljnjemu razvoju in varstvu romske skupnosti, ima danes v Evropi prav razprava o pozitivni diskriminaciji romske skupnosti na področju izboljšanja neugodnega socialnega položaja ter o posebnih ukrepih za odpravo predsodkov in rasnega sovraštva. V skladu s Priporočilom parlamentarne skupščine Sveta Evrope št. 1557 iz leta 2002 o pravnem položaju Romov v Evropi, ki povzema bistvene ugotovitve o pravnem položaju Romov v posameznih državah v Evropi, se avtorica zavzema za to, da se Romom v notranji zakonodaji prizna status narodne manjšine v vsaki državi, kjer živijo, in zagotovijo individualne ter kolektivne manjšinske pravice. Prispevek podrobneje obravnava določbe dveh posebnih zakonov o varstvu manjšin, ki sta bila sprejeta v Srbiji in Črni gori (2002) in na Poljskem (2005), ter temeljita na evropskih standardih manjšinskega varstva. Romi zaradi zgodovinskih okoliščin in odklanjanja večinskega prebivalstva živijo v neugodnih socialnih razmerah in so še vedno marginalizirani ter izpostavljeni predsodkom. V teh dokumentih so Romi obravnavani predvsem kot socialno ogrožena / ranljiva skupina, ki ji mora družba zagotoviti možnosti za vključitev v družbo. V letu 2004 so vrhunski pravni eksperti EU predlagali sprejem posebne ĆDirektive o vključevanju RomovĆ. Ob tem se vsiljuje vprašanje, ali je pravna obravnava Romov kot socialno ranljive skupine zadostna podlaga za uresničitev vizije romskega naroda, ali je to zgolj še ena pragmatična rešitev, ki ne posega v vsebinska razvojna vprašanja, in v ničemer ne ogroža razmerij moči v okviru obstoječih političnih strukturTEXTznanstveno časopisjejournalsSlovenian National E-content AggregatorNational and University Library of SloveniaInštitut za narodnostna vprašanja
