There are several instances in which civil forfeiture procedure relies heavily on the on-going criminal prosecution of persons of interest. This solution is welcomed insofar as it strengthens the legitimacy of civil forfeiture: it can never fully replace criminal prosecution. On the other hand, reliance on criminal prosecution places considerable restrictions on civil forfeiture procedures: in most cases, they can effectively proceed as long as criminal prosecution is in place"},{"@xml:lang":"sl","#text":"Avtor analizira nekatere vidike razmerja med kazenskim pravom in civilnopravnim ukrepom odvzema premoženja nezakonitega izvora, kot ga pozna slovenski Zakon o odvzemu premoženja nezakonitega izvora (ZOPNI). Zakonodajalec je v postopek odvzema vključil več točk, ki postopanje pristojnih organov po ZOPNI navezujejo na tek (pred)kazenskega postopka zaradi tako imenovanih kataloških kaznivih dejanj. Ta navezava sicer krepi legitimnost odvzema premoženja nezakonitega izvora, ker ta nikoli ne more povsem nadomestiti kazenskega pregona. Vendar pa zaradi teh prepletanj lahko trpi učinkovitost postopkov odvzema.
