It draws attention to the diversification of the regulatory framework of legal standards of emission law and focuses on current problems with these legal standards in practice, with regard that the courts have already adopted single positions on certain dilemmas. The author compares the multiplicity and vagueness of some of the standards offered by the Slovenian legislation with the legal regulation of Germanic countries. The article highlights the legal terminology in German, Austrian and Swiss legal systems, where it, in particular with the analysis of their case-law, indicates that it is possible to unify legal standards. Such a solution would be possible in the case of a uniform civil code. However, until then, it is the jurisprudence, which will have to take care of the design and the uniform application of legal standards, which are in the Slovenian legal system based on property law and law of obligationsPrispevek opredeljuje pomen pravnih standardov in vlogo sodišča pri zapolnjevanju njihove vsebine. Opozarja na razpršenost normativne ureditve imisij v pozitivnem pravu in se osredotoča na aktualne probleme teh standardov v sodni praksi. Številnost in nejasnost nekaterih pravnih standardov, ki jih ponuja slovenska zakonodaja, primerja s pravno ureditvijo germanskega kroga. S predstavitvijo normativne ureditve imisij v nemški, avstrijski in švicarski pravni ureditvi, zlasti pa njihove pravne teorije in sodne prakse, nakaže, da je pravne standarde mogoče poenotiti in urediti na enem mestu. Takšna rešitev bi bila mogoča v enotnem civilnem zakoniku.
