It considers the false self-employed, who perform their work in a dependent relationship, but are not given the status of an employee. Another example are triangular employment relationships, in which the true employer is concealed, either through permanent assignment of employees to the user undertakings or through false contracts on business cooperation. The author also examines conclusion of atypical employment contracts, especially of part-time employment contracts that are concluded in spite of the need for full-time work. The article critically evaluates the listed examples and presents possible ways of their prevention"},{"@xml:lang":"sl","#text":"V prispevku so obravnavani primeri neuporabe institutov delovnega prava in njihove uporabe v nasprotju z namenom. Obravnavani so navidezno samozaposleni, ki opravljajo delo v razmerju odvisnosti, a se jim ne prizna status delavca. Drugi primer so tristranska delovna razmerja, pri katerih se prikriva pravega delodajalca, bodisi s trajnim napotovanjem delavcev k uporabnikom ali z navideznimi pogodbami o poslovnem sodelo-vanju. Avtorica se ukvarja tudi s sklepanjem atipičnih pogodb o zaposlitvi, predvsem pogodb o zaposlitvi s krajšim delovnim časom, kljub potrebi po delu za polni delovni čas.
