Redistribution of obligations between a formal and a non-formal employer could increase flexibility for enterprises, but not on the burden of a temporary agency worker; his legal position should not be worse only because of the fact, that he is not directly employed by the user undertaking. The author is committed to consistent implementation of the principle of equal treatment without derogations, including in case of posted agency workers as well as in cases of other new forms of dependent work outside of the standard employment relationship"},{"@xml:lang":"sl","#text":"Prispevek se osredotoča na pravni položaj agencije, podjetja uporabnika in agencijskega delavca z vidika implementacije načela enakega obravnavanja. Razdelitev obveznosti med dejanskega in formalnega delodajalca lahko spodbuja večjo fleksibilnost za podjetja, vendar ne na breme agencijskega delavca; njegov pravni položaj ne sme biti slabši samo zaradi dejstva, ker ni neposredno zaposlen pri podjetju uporabniku.
