This raises the question whether its adoption was necessary to achieve such an aim. Further, the authors point out the constitutional controversy in defining the conditions for financial investigation in the light of the principles of proportionality, legality and equality. They conclude that, by adopting ZOPNI in order to fight organized crime, the legislator has disproportionately sacrificed the freedom of individuals and has therefore joined the general trend towards downgrading human rights (at least in a declarative manner) in the name of protecting national security"},{"@xml:lang":"sl","#text":"Avtorja v prispevku ugotavljata, da je primarni cilj Zakona o odvzemu premoženja nezakonitega izvora (ZOPNI) odvzeti premoženje, za katero se sumi, da je bilo pridobljeno s kaznivimi dejanji, kar vzpostavlja dvom o nujnosti sprejema tega zakona. V nadaljevanju opozarjata na ustavno spornost opredelitve pogojev za odreditev postopka finančne preiskave z vidika načel sorazmernosti, zakonitosti in enakosti.
