Business practice has experienced the need for the possibility of non-banking entities to provide independent security with the possibility of redemption at the first request without objection. Independent non-banking guarantee and suretyship on first demand are two such instruments that have evolved in comparative jurisdictions. The article discusses the reasons for and against the recognition of these two forms of securing of claims in Slovenian law. It concludes that both instruments are legally feasible, whereby non-banking guarantee is non-accessory while suretyship on first demand has only limited accessoriness. In both instances, certain restrictions are to be applied within relationships with weaker parties"},{"@xml:lang":"sl","#text":"V slovenskem pravu je poroštvo vedno strogo akcesorna oblika zavarovanja obveznosti, bančna garancija na prvi poziv, ki je v praksi najpogostejša vrsta bančne garancije, pa je neakcesorne narave, kar pomeni, da obveznost banke ni odvisna od obstoja zavarovane terjatve. V poslovni praksi je prisotna potreba, da bi tudi nebančni subjekti lahko zagotovili neodvisno zavarovanje obveznosti z možnostjo unovčenja na prvi poziv brez ugovorov. V tujih pravnih redih se kot takšna instrumenta pojavljata neodvisna nebančna garancija in poroštvo na prvi poziv. Članek preučuje razloge za priznavanje in proti priznavanju tovrstnih novih oblik zavarovanja terjatev po slovenskem pravu. Ugotavlja, da sta pravno izvedljiva oba instrumenta, pri čemer je nebančna garancija neakcesorna, poroštvo na prvi poziv pa le omejeno akcesorno.
