Numerous dilemmas exist. It is clear that an arbitration tribunal may not issue an EBTD or an European Payment Order. It is very doubtful whether an arbitral tribunal may be (by virtue of rules of an arbitral institution) empowered to issue a payment order. The most important question is, whether a claimant, who requests the state court to issue a payment order, in this manner tacitly expresses his will to revoke arbitration agreement or may he/she nevertheless retain the right that in case of the defendant's objection against the payment order, the dispute is finally decided by arbitrationAvtor obravnava vprašanje, ali sta arbitraža na eni strani in postopek plačilnega naloga ter izvršbe na podlagi verodostojne listine (IVL) v slovenskem pravu na drugi strani kompatibilna. Obstajajo številni dvomi. Jasno je sicer, da arbitraža ne more izdati sklepa o izvršbi na podlagi verodostojne listine ali evropskega plačilnega naloga. Je pa zelo sporno, ali lahko (na podlagi pravilnika stalne arbitraže) izda navaden plačilni nalog.
