By granting a concession to manage integrated public passenger transport ("tactical level") in a competitive procedure to the best tenderer, a market test of objectively necessary management costs will be ensured and management will be more efficient than if the state sets up a company for this purpose and grants the concession to it unconditionally. On the basis of the arguments confirming the hypothesis, the author criticises the proposal for a legislative arrangement of management in the Republic of Slovenia (hereinafter RS) and prepares a proposal on how the legislature should regulate the issue of management in order to achieve the ratio legis of Regulation (EC) No 1370/2007, Regulation (EU) No 2016/2338, and national programme documents</dc:description><dc:description xml:lang="sl">V članku avtor na podlagi rezultatov relevantnih študij o neučinkovitosti podjetij v javni lasti kot posledice vpliva politike na izvajanje nadzora preizkuša hipotezo, po kateri bo s podelitvijo koncesije za upravljanje integriranega javnega potniškega prometa ("taktični nivo") najugodnejšemu ponudniku v konkurenčnem postopku zagotovljen tržni preizkus objektivno potrebnih stroškov upravljanja, upravljanje pa bo učinkovitejše, kot če bi država v ta namen ustanovila podjetje, ki bi mu podelila brezpogojno koncesijo.
