The author points out that rigidity is not always required in public procurement. Furthermore, insisting on strictly complying with the rules can endanger the public procurement's main objective - an equal treatment of all tenderers. Slovenian rules on public procurement in the case of incomplete tender and under specific conditions explicit enable bidders to submit the relevant information or document after the deadline. Relevant rules on formally incomplete tender and incomplete tender are being amended with the acts amending Public Procurement Act (ZJN-2E) and Act Regulating Public Procurement in Water, Energy, Transport and Postal Services (ZJNVETPS-E). The author deals with the recent European Court of Justice case law on incomplete tenders and new Slovenian rules on submitting the missing or incorrect document to complete tender"},{"@xml:lang":"sl","#text":"V primerjavi s splošnimi pravili o sklepanju pogodb je za oddajo javnih naročil značilna formalnost, včasih celo togost, kar pa je v posameznih primerih posledica napačne razlage pravil o javnem naročanju. Avtorica poudarja, da cilji javnega naročanja ne zahtevajo vedno strogosti pri izpolnjevanju obveznosti ter da lahko pretiran formalizem ogrozi poglavitni cilj javnega naročanja, to je enakopravno obravnavo ponudnikov. Slovenska pravila javnega naročanja izrecno omogočajo, da ponudnik, ki je oddal pomanjkljivo ponudbo, to dopolni tudi po roku za oddajo ponudb, a le če so izpolnjeni posebni pogoji. Relevantna pravila o formalno nepopolni ponudbi in nepopolni ponudbi so bila spremenjena z novelo ZTN-2E in ZINVETPS-E.
