The article also deals with the question of whether, and under what conditions, franchising is concerned with the transfer of the undertakingV prispevku so, izhajajoč iz raznovrstnosti franšiznih razmerij, analizirana vprašanja, ali bi lahko v razmerju med dajalcem franšizinga in jemalcem franšizinga obstajali elementi delovnega razmerja (prikrito delovno razmerje), ali bi pridobitelj franšizinga lahko imel oziroma moral imeti status ekonomsko odvisne osebe in ali bi dajalec franšizinga moral prevzeti vsaj del delodajalskih obveznosti do delavcev pridobitelja franšizinga.
