From judgements of the court presented in the article it is clear what the Court considered the relevant facts when determining the elements of the employment relationship. In this respect the formal status of the worker is not of importance; the Employment Relationship Act even presumes an employment relationship whereby the will of the contractors is not of importance. The paper further features the method of judicial protection, since it is clear from the case-law that the plaintiffs must pay particular attention to this issueV članku so predstavljeni sodni primeri, v katerih so tožniki zahtevali ugotovitev obstoja delovnega razmerja, ker so menili, da ima delo, ki ga opravljajo, vse elemente delovnega razmerja. Iz predstavljenih sodnih odločb je razvidno kaj sodišče šteje za relevantna dejstva, ko ugotavlja elemente delovnega razmerja. Formalni status izvajalca dela pri tem ni pomemben, zakon o delovnih razmerjih celo vzpostavlja domnevo delovnega razmerja in volja pogodbenikov ni pomembna.
