In a situation where it is becoming an inevitable part of election or referendum campaigns and a big industry, it is difficult to advocate regulation limited to (traditional) media, outdoor advertising and rallies - as is the case in Slovenia and many other European countries. Citizens are increasingly agnostic to which device or platform they receive the content from, and they deserve a comparable level of protection and transparency. Fearing that opaque and often manipulative online advertising practices threaten democracy, the European Union is preparing a series of measures. But designing democratic yet effective solutions in a transnational digital environment dominated by a handful of private actors is challenging. Digital services often can not be unambiguously territorially located; political campaigns are not limited to elections but are permanent; and advertising can be done by anyone, regardless of a visible connection to a political party, candidate, or political agenda. In addition, the nascent regulatory framework will need to address a number of issues that are not adequately dealt with in the existing, mostly pre-digital regulatory models. At the same time, care must be taken to ensure that the platforms are not given even more decision-making power in matters concerning freedom of expression and political debate, as well as free and fair elections"},{"@xml:lang":"sl","#text":"Ta prispevek kritično osvetli regulativne pobude glede spletnega političnega oglaševanja. V razmerah, ko to postaja neizogibni del volilnih ali referendumskih kampanj in velik posel, je težko vztrajati pri regulaciji, omejeni na (tradicionalne) medije, plakatno oglaševanje in predvolilne shode - kot to velja za Slovenijo in mnoge druge evropske države. Državljani vse manj razlikujejo med napravami in platformami, prek katerih sprejemajo vsebine, ter so upravičeni do primerljive stopnje zaščite in transparentnosti. V bojazni, da nepregledne in pogosto manipulativne spletne oglaševalske prakse ogrožajo demokracijo, Evropska unija pripravlja več ukrepov. A oblikovanje demokratičnih in obenem učinkovitih rešitev v transnacionalnem digitalnem okolju, ki ga obvladuje peščica zasebnih akterjev, ni enostavno. Digitalnih storitev pogosto ni mogoče nedvoumno locirati; politične kampanje niso več omejene na volitve, ampak se izvajajo nepretrgano; oglašuje pa lahko vsakdo, ne glede na vidno povezavo s politično stranko, kandidatom ali politično agendo. Poleg tega bo pri vzpostavljanju regulativnega okvira treba rešiti številna vprašanja, ki niso ustrezno urejena niti v sedanjih, večinoma preddigitalnih modelih regulacije.
