In addition, the authors give arguments and illustrative examples that question the appropriateness of the established case-law in the situation, where none of the spouses was the housing right holder, however one of them realized the right to buy as a close family member of the housing right holder with his/her consent. The authors argue that in such situation the pecuniary nature of the right to buy should be reflected in the determination of shares on community property as a contribution of separate property of one of the spouses to the community property. The authors offer a solution that enables the right to buy to be taken into account in the determination of shares on community property with the minimum interference in the existing case-law</dc:description><dc:description xml:lang="sl">Avtorja v prispevku najprej predstavita ustaljeno stališče sodne prakse, da ugodnosti odkupa stanovanja po Stanovanjskem zakonu v primeru, ko je odkup financiran iz skupnih sredstev, ni mogoče šteti v korist enega od zakoncev, temveč v korist obeh. V nadaljevanju navedeta in s konkretnimi primeri ponazorita argumente, ki zbujajo dvom o pravilnosti omenjenega stališča za primere, ko nobeden od zakoncev ni bil imetnik stanovanjske pravice, pravico do odkupa pa je eden od njiju kot ožji družinski član uresničil s privolitvijo imetnika stanovanjske pravice. Po mnenju avtorjev bi se v teh primerih premoženjska narava odkupne pravice morala odraziti pri določitvi deležev na skupnem premoženju, in sicer kot vložek posebnega premoženja enega od zakoncev v skupno premoženje.
