Economic operators from third countries, which do not have any trade agreement providing for open access to the EU procurement market or whose goods, services and works are not covered by such an agreement, do not have secured access to procurement procedures in the EU and may be excluded. Communication from the Commission - Guidance on the participation of third-country bidders and goods in the procurement market - interprets EU policy on third-country access in public procurement and applicable rules of directives on these issues. The Guidance does not have its own binding power, but the Intervention Act (IZOOPIZG) obliges authorities to follow the Guidance when submitting important investments. The article analyses authorities'' obligations and options in relation to third-country bidders</dc:description><dc:description xml:lang="sl">Pravila javnega naročanja ne zagotavljajo dostopa do trga javnih naročil EU vsem gospodarskim subjektom iz tretjih držav. Osebe iz tistih tretjih držav, ki nimajo z EU sklenjenega trgovinskega sporazuma o odprtem trgu javnih naročil EU ali katerih blago, storitve in gradnje niso zajeti s sporazumom, so lahko izključene iz postopkov javnega naročanja. Sporočilo Komisije Smernice o udeležbi ponudnikov in blaga tretje države na trgu javnih naročil EU pojasnjuje politiko EU o dostopu ponudnikov iz tretjih držav in pravila javnega naročanja v zvezi s temi vprašanji. Smernice nimajo lastne obveznostne moči, a interventni zakon (IZOOPIZG) zavezuje naročnike, da jih uporabljajo ob oddaji pomembnih investicij.
