It has the legal roots in the diplomatic protection which has developed in international law in order to protect a foreigner's rights in a perpetrator state on behalf of the state of his nationality. Today, the legal relations between the investor and the host state are regulated in the bilateral and multilateral investment treaties which form the most important part of the law on foreign investments while the arbitration is the most commonly used means to settle the investment disputes. Slovenia has concluded a substantial number of these treaties and must find an appropriate balance between its position as the state promoting the investments of its nationals abroad and the host stateZaščita tujih naložb je urejena v mednarodnem pravu in je rezultat potrebe po zaščiti tujega investitorja in njegovega premoženja pred razlastitvijo na ozemlju države gostiteljice. Pravne korenine ima v diplomatski zaščiti, ki se je razvila v mednarodnem pravu z namenom zaščititi pravice tujca v državi kršiteljici s strani države njegovega državljanstva. Danes so pravni odnosi med investitorjem in državo gostiteljico urejeni z bilateralnimi in multilateralnimi mednarodnimi pogodbami, ki predstavljajo najpomembnejši del investicijskega prava, medtem ko je arbitraža najbolj običajno sredstvo za reševanje investicijskih sporov.
