Beforehand, the Arbitral Tribunal in its Partial Award on 30 June 2016 found that albeit Slovenia has violated provisions of the Arbitration Agreement, it remains in force and necessitates continuation of arbitral proceedings. Croatia decided not to participate in the remaining proceedings and also entirely rejected the arbitral award. The award is being implemented only by Slovenia, which continuously calls on Croatia to respect its international legal commitments. Slovenia sought to prove before the Court of Justice of the European Union, and its citizens before the European Court of Human Rights, with Slovenia's intervention, violations of obligations by Croatia under EU law and the European Convention on Human Rights, respectively. While in the first case, the court declared itself without jurisdiction, in the second instance, the section of the court declared the complaints inadmissible. Nevertheless, these decisions of the two courts raised some pertinent questions that deserve further attention also by international law scholars, which is highlighted in this article. It remains to be seen when and under what conditions will the situation on the ground be settled in accordance with the final and binding award or, potentially, any settlement included in a subsequently concluded agreement, should the two states decide to follow this path. Some ideas on how to further a meaningful 'international life' of the arbitral award are included in this article</dc:description><dc:description xml:lang="sl">Dne 4. 11. 2009 sta predsednika hrvaške in slovenske vlade podpisala Arbitražni sporazum za predložitev njunega mejnega spora arbitraži, nekaj manj kot osem let kasneje, dne 29. 6. 2017, pa je arbitražno sodišče na javni seji v Palači miru v Haagu izreklo svojo končno razsodbo. Še pred tem je arbitražno sodišče v svoji delni razsodbi z dne 30. 6. 2016 ugotovilo, da čeprav je Slovenija kršila določila Arbitražnega sporazuma, ta še naprej velja in zahteva nadaljevanje arbitražnega postopka. Hrvaška se je odločila, da ne bo sodelovala v preostalem postopku, in v celoti zavrača tudi končno razsodbo. Razsodbo izvaja le Slovenija, ki nenehno poziva Hrvaško, naj spoštuje svoje mednarodnopravne obveznosti. Slovenija je skušala pred Sodiščem Evropske unije, njeni državljani pa pred Evropskim sodiščem za človekove pravice ob intervenciji Slovenije dokazati kršitve obveznosti s strani Hrvaške po pravu EU in po Evropski konvenciji o človekovih pravicah. Medtem ko se je v prvem primeru sodišče razglasilo za nepristojno, je v drugem sekcija tega sodišča pritožbe razglasila za nedopustne. Kljub temu sta odločitvi obeh sodišč razstrli nekatera pomembna vprašanja, ki zaslužijo pozornost tudi strokovnjakov za mednarodno pravo, kar je poudarjeno v tem prispevku. Neznano ostaja, kdaj in pod katerimi pogoji bo stanje na terenu urejeno skladno s končno in zavezujočo razsodbo ali pa morebitno rešitvijo, ki bi bila vključena v kasneje sklenjen sporazum, če se bosta državi odločili slediti tej poti.
