Comparing the law of obligations, the obligations of the contracting authority from public procurement to claim sanctions for breaches of the contract are different. It should be taken in account whether the party is liable for the breach of public procurement contract and whether the damage is caused. Additionally, the article discusses the cases where contract parties agree on the contractual penalty for delay and bank guarantee for timely fulfilment of obligationsAvtorica analizira pogoje, ki morajo biti izpolnjeni, da je dogovor o podaljšanju roka za izpolnitev, kot je bil prvotno določen v pogodbi o javnem naročilu, veljaven.
