As State Succession accompanies any change in territory, i.e. the transfer of territory from one State to another, the question always arises of the continued existence of rights and obligations of the First State that existed concerning that territory until the date of succession. Older theories rejected the possibility of the succession of rights and obligations that exist between states, which applied not only to international responsibility but to other succession matters (property, archives, debts, international treaties) as wellNa podlagi nasledstvenih procesov se je na svetu število samostojnih držav od leta 1913 povzpelo s komaj 48 na današnjih 193 (upoštevajoč zgolj članice OZN), kar dokazuje tako pogostost kot tudi močan pomen nasledstva držav. Nasledstvo spremlja vsakršno spremembo ozemlja, t.j. prehod ozemlja od ene k drugi državi, zato ob tem vselej nastane vprašanje nadaljnjega obstoja pravic in obveznosti prve države, ki so do datuma nasledstva obstajale v odnosu do tega ozemlja.
