It focuses on the basic outline of the law on protection against discrimination and presents it as an independent legal category that similarly to other legal disciplines consists of basic elements. The latter help to identify discrimination on a highly abstract level. The authors thus present some basic concepts of the anti-discrimination law, such as personal grounds, assessment of comparable situations, exemptions of the prohibition of discrimination, etc. In addition to the theoretical basis, the case law of Slovenian courts and the Advocate of the Principle of Equality is reviewed. The paper also points out some pressing issues that the (relatively modest) jurisprudence has not yet been able to address"},{"@xml:lang":"sl","#text":"Prispevek obravnava aktualna vprašanja (slovenskega) protidiskriminacijskega prava. Osredotoča se na splošen oris strukture prava varstva pred diskriminacijo kot samostojne pravne kategorije, ki se podobno kot (nekatere) druge pravne discipline opira na logiko več elementov, na podlagi katerih diskriminacijo prepoznavamo. Avtorja tako predstavita temeljne pojme, kot so osebna okoliščina, primerniki, izjeme od prepovedi diskriminacije ipd. Ob teoretičnih izhodiščih je del besedila namenjen pregledu sodne prakse in prakse Zagovornika načela enakosti kot osrednjega nosilca protidiskriminacijskega varstva v našem prostoru.
