As national courts must take soft law into account in certain aspects following the established position in the Grimaldi case, this article, through a study of legal theory and case law of Slovene courts, offers an insight into the attitude of Slovenian courts towards EU soft law, as well as national soft law, compares both types of acts regarding their content, functions and possibility of their challenge before the Court of Justice or the Constitutional Court of the Republic of Slovenia, and finally draws a conclusion on the role of soft law in SloveniaVloga aktov mehkega prava kot aktov brez formalno zavezujoče moči se je na ravni EU v zadnjih treh desetletjih, tudi zaradi bolj pozitivnega odnosa Sodišča EU do teh aktov, povečala. Ker morajo po ustaljenem stališču iz zadeve Grimaldi nacionalna sodišča v določeni meri upoštevati akte mehkega prava, prispevek skozi stališča pravne teorije in raziskavo sodne prakse slovenskih sodišč ponuja vpogled v odnos slovenskih sodišč do mehkega prava EU in tudi do nacionalnega mehkega prava, obe vrsti prava medsebojno primerja glede vsebine, funkcij in možnosti izpodbijanja pred Sodiščem EU oziroma Ustavnim sodiščem RS ter na koncu ponuja zaključek o vlogi aktov mehkega prava v slovenskem prostoruTEXTznanstveno časopisjejournalsSlovenian National E-content AggregatorNational and University Library of Slovenia
