The Directive on common rules for the internal market for electricity and amending Directive 2012/27/EU (Directive) sets forth the obligation to install smart metering systems that measure the consumption of electricity in households. Some data collected by these systems contain (highly sensitive) personal data, as it is possible to obtain information about the behaviour of the members of the households through their analysis (for example, when someone returns home from work, when a specific household appliance is turned on, etc.). For this reason, the Directive also contains provisions on the protection of personal data gathered by smart metering systems that closely rely on the provisions of the GDPR. There are, however, some inconsistencies between the data protection regimes set forth by the two acts. The relevant provisions of the Directive are transposed to the Slovenian legal order by the Electricity Supply Act, which contains provisions on the installation of smart metering systems and their technical specifications, as well as the protection of personal data collected by them in Section 2 of Chapter IIV pravnem redu Evropske unije je pravica do varstva osebnih podatkov temeljna človekova pravica, ki jo na ravni primarnega prava zagotavljata Listina o temeljnih pravicah in Pogodba o delovanju Evropske unije, na ravni sekundarnega prava pa jo sistematično ureja Splošna uredba o varstvu osebnih podatkov (GDPR). Direktiva o skupnih pravilih notranjega trga električne energije in spremembi Direktive 2012/27/EU določa obveznost namestitve sistemov naprednega merjenja porabe električne energije, ki zbirajo podatke o porabi električne energije v posameznih gospodinjstvih. Nekateri tako pridobljeni podatki spadajo med (izjemno občutljive) osebne podatke, iz njih je namreč mogoče razbrati navade članov gospodinjstva (na primer kdaj se kdo vrne domov, kdaj vklopi določen gospodinjski aparat), zato direktiva vsebuje tudi določbe o varstvu tako pridobljenih osebnih podatkov, ki v pretežnem delu sledijo določbam GDPR, vendar pa so med režimoma varstva osebnih podatkov iz teh dveh aktov razlike.
