Almost irrespective of the context, there seems to be no more appealing connecting factor than a habitual residence. It makes one wonder what exactly is so appealing about it. Is it the ease of determining habitual residence? Or maybe legal certainty? Uniformity? Flexibility? All these questions are legitimate and require answers in order to grasp the concept, its advantages and disadvantages.
