Special attention is paid to UBI with regards to finding effective measures to address the consequences of the COVID-19 pandemic. The latter has further stimulated discussions on the functioning of social security systems and whether they are still able to effectively address the challenges raised or highlighted by the pandemic in their existing form. The article considers UBI as a possible replacement for the social assistance system and the wider social security system, which also requires a thorough analysis of the legal consequences of its introduction into the existing system. The answer to the question of why we should even consider replacing social assistance with UBI can be found primarily in the shortcomings of the existing social assistance system and in the advantages of UBI. It must be remembered, however, that the elements of UBI are fundamentally different from social security and social assistance rights, which is also the main argument against the replacement of the existing systems, or parts thereof, with UBI. Although the social security system faces many challenges, the discussion about its replacement also shows the advantages and thus the importance of maintaining and adapting the existing social security system. UBI can be one of the possible ways to change and adapt it, but it can not be the only solution to all existing and future challenges of the social security system</dc:description><dc:description xml:lang="sl">Ideja univerzalnega temeljnega dohodka (UTD) v zadnjih letih znova postaja zanimiva kot odziv na izzive, kot so prekarizacija na trgu dela, nestandardne oblike dela, naraščanje brezposelnosti, revščine in neenakosti v družbi, posebna pozornost pa je UTD namenjena tudi glede iskanja učinkovitih ukrepov za odpravljanje posledic pandemije bolezni covid-19. Ta je še dodatno spodbudila razprave o delovanju sistemov socialne varnosti in vprašanju, ali so ti v sedanji obliki še sposobni učinkovito reševati izzive, ki jih je pandemija prinesla ali poudarila. Prispevek obravnava UTD kot možno nadomestitev sistema socialnega varstva in širšega sistema socialne varnosti, kar zahteva tudi temeljito analizo pravnih posledic njegove uvedbe v sedanji sistem. Odgovor na vprašanje, zakaj sploh razmišljati o nadomestitvi sistema socialnega varstva s sistemom UTD, lahko najdemo predvsem v pomanjkljivostih sedanjega sistema socialnih pomoči in v prednostih UTD. Pri tem je treba upoštevati, da opredelilni elementi UTD tega v izhodišču razlikujejo od pravic, ki se upravičencem zagotavljajo iz sistema socialne varnosti oziroma ožjega sistema socialnega varstva, iz česar izhajajo tudi razlogi proti. Čeprav se sedanji sistem socialne varnosti in njegovi podsistemi srečujejo z mnogimi izzivi, razprava o njihovi nadomestitvi namreč pokaže tudi na prednosti in s tem pomen ohranitve, a prilagoditve sedanjega sistema socialne varnosti.
