Innovations in medicine present potential for improving diagnosis and treatment. Simultaneously, they raise certain questions about civil liability and the legal position of the patient who has suffered harm caused by a defective digital product. This paper examines whether the modernized EU liability rules for defective digital medical devices can alleviate the evidentiary burden patients face in civil litigation, thus strengthening their position. The author focuses on the adequacy of the new rules on disclosure of evidence and burden of proof. The key findings show that the new rules strengthen patients' position by alleviating the burden of proof and imposing an obligation to disclose relevant evidence. The author proposes drafting guidelines to resolve existing ambiguities, ensuring the new evidentiary framework is applied consistently and effectively</dc:description><dc:description xml:lang="sl">Digitalizacija je spremenila zdravstveni sektor z uvedbo naprednih digitalnih medicinskih pripomočkov (kot so npr. programska oprema, medicinski pripomočki in pripomočki, ki jih podpirajo sistemi umetne inteligence). Ključne ugotovitve kažejo, da nova pravila krepijo položaj pacientov z zmanjšanjem dokaznega bremena in uvedbo obveznosti razkritja relevantnih dokazov. Avtor predlaga pripravo smernic za rešitev obstoječih nejasnosti, s čimer bi se zagotovila dosledna in učinkovita uporaba novega dokaznega okvira</dc:description><edm:type>TEXT</edm:type><dc:type xml:lang="sl">znanstveno časopisje</dc:type><dc:type xml:lang="en">journals</dc:type><dc:type rdf:resource="http://www.wikidata.org/entity/Q361785" /></edm:ProvidedCHO><ore:Aggregation rdf:about="http://www.dlib.si/?URN=URN:NBN:SI:DOC-73V9BMUB"><edm:aggregatedCHO rdf:resource="URN:NBN:SI:DOC-73V9BMUB" /><edm:isShownBy rdf:resource="http://www.dlib.si/stream/URN:NBN:SI:DOC-73V9BMUB/223c8fd4-6a36-471d-aa8b-c360d90868c1/PDF" /><edm:rights rdf:resource="http://creativecommons.org/licenses/by/4.0/" /><edm:provider>Slovenian National E-content Aggregator</edm:provider><edm:intermediateProvider xml:lang="en">National and University Library of Slovenia</edm:intermediateProvider><edm:dataProvider xml:lang="sl">Univerza v Mariboru, Pravna fakulteta</edm:dataProvider><edm:object rdf:resource="http://www.dlib.si/streamdb/URN:NBN:SI:DOC-73V9BMUB/maxi/edm" /><edm:isShownAt rdf:resource="http://www.dlib.si/details/URN:NBN:SI:DOC-73V9BMUB" /></ore:Aggregation></rdf:RDF>
