The draft is not addressing the legal issues of existing public institutions - long-term care providers. The new rules governing the public institutions do not differ from the existing, obsolete solutions. The article analyses the current regulation and the proposed draft, and suggests new solutions. Long-term care providers are ipso facto economic providers who provide the services on a competitive market. We are suggesting the transformations of the public institutions into companies governed by corporate law. This transformation could improve corporate government and get the providers out of the sometimes very limiting public sector regulations. The proposed solutions could be also the model for the changes in the similar areas of the public sector"},{"@xml:lang":"sl","#text":"Vlada RS je v Državni zbor poslala nov predlog Zakona o dolgotrajni oskrbi. Zakon ne ureja statusnih sprememb dosedanjih javnih zavodov na tem področju. V članku pregledamo dosedanjo in v osnutku predlagano ureditev tega področja. Ta se ne razlikuje od sedanjih, davno obsoletnih rešitev. Predlagamo rešitve, ki bi lahko pomenile smer preoblikovanja javnih socialno varstvenih zavodov. Ker ti izvajajo storitve na trgu, bi se lahko preoblikovali v družbe gospodarskega prava v lasti države. S tem bi izboljšali korporativno upravljanje in se izognili uporabi mnogih pretirano omejujočih določb javnega sektorja.
