However, this model has its very clear limits when applied to high-risk and vulnerable patients whose decision-making capacity is impaired. This study examines what lies behind consent in healthcare and asks how legal systems can protect high-risk patients without undermining their dignity, agency and human rights. The analysis adopts a comparative legal approach. It relies on international instruments and national examples from diverse legal traditions. The article argues that vulnerability should not serve as a justification for paternalism or uncontrolled coercion. Going beyond consent does not mean abandoning autonomy, it means reconceptualizing it in a way that ensures selfdetermination and protection for those most vulnerable in health care systems</dc:description><dc:description xml:lang="sl">Sodobno zdravstvo temelji na načelu prostovoljne privolitve, ki je podlaga za avtonomijo in samoodločanje pacientov. Preseganje soglasja ne pomeni opustitve avtonomije, temveč njeno ponovno opredelitev na način, ki zagotavlja samoodločanje in zaščito tistih, ki so v sistemih zdravstvenega varstva najbolj ranljivi</dc:description><edm:type>TEXT</edm:type><dc:type xml:lang="sl">znanstveno časopisje</dc:type><dc:type xml:lang="en">journals</dc:type><dc:type rdf:resource="http://www.wikidata.org/entity/Q361785" /></edm:ProvidedCHO><ore:Aggregation rdf:about="http://www.dlib.si/?URN=URN:NBN:SI:DOC-5X24W7H8"><edm:aggregatedCHO rdf:resource="URN:NBN:SI:DOC-5X24W7H8" /><edm:isShownBy rdf:resource="http://www.dlib.si/stream/URN:NBN:SI:DOC-5X24W7H8/733bd843-02f2-4b0c-8f4f-73e72429497a/PDF" /><edm:rights rdf:resource="http://creativecommons.org/licenses/by/4.0/" /><edm:provider>Slovenian National E-content Aggregator</edm:provider><edm:intermediateProvider xml:lang="en">National and University Library of Slovenia</edm:intermediateProvider><edm:dataProvider xml:lang="sl">Univerza v Mariboru, Pravna fakulteta</edm:dataProvider><edm:object rdf:resource="http://www.dlib.si/streamdb/URN:NBN:SI:DOC-5X24W7H8/maxi/edm" /><edm:isShownAt rdf:resource="http://www.dlib.si/details/URN:NBN:SI:DOC-5X24W7H8" /></ore:Aggregation></rdf:RDF>
