A., Trieste - 1953 ALLIED MILITARY GOVERNMENT British - United States Zone-Free Territory of Trieste Order No. 1 REGULATIONS FOR THE IMPLEMENTATION OF THE CODE OF NAVIGATION (MARITIME NAVIGATION) WHEREAS it is deemed advisable to issue new Regulations for the imple mentation of the Code of Navigation (Maritime Navigation) in that part of the Free Territory of Trieste administered by the British-United States Forces (hereinafter referred to as the „Zone“), NOW, THEREFORE, I, SIR JOHN WINTERTON, KCMO, CB, CBE, Major General, Zone Commander, ORDER: ARTICLE I The provisions contained in the Regulations for the implementation of the Code of Navigation (Maritime Navigation), as approved by D. P. R. 15 February 1952, No. 328, (hereinafter referred to as the „Decree“) are hereby enacted in so far as applicable in the Zone, with the exception that the consuls and vice-consuls referred to in Article 176, the councillors referred to in Article 177 and the auditors referred to in Article 180 shall hold office for a term of one year, the respective elections being held annually between 1 January and 31 March of each year. ARTICLE II Section 1. — Copies of the Decree which is made part of this Order and marked „Annex A“ shall be deposited at thé Directorate of Legal Affairs, Allied Military Government, and at the Harbour Master’s Office, where they may be freely examined by all persons interested. Section 2. — No provisions contained in the Decree shall vest any jurisdiction in the Italian State or in any person or body operating under its authority, with regard to persons, properties or matters existing in the Zone. Section 3. — All references to the Ministries of the Italian Government made in the Decree shall be deemed to be deleted and substituted by the corresponding Directorates, Departments, Offices etc. of Allied Military Government. ARTICLE III Order No. 62 dated 10 April 1951, Order No. 21 dated 3 February 1951 and all laws and regulations inconsistent with the Decree are repealed. T. J. W. WINTERTON Major General Ref. : LDjAj52/147 Zone Commander Order No. 2 AMENDMENTS TO THE CONSOLIDATED TEXT OF LAWS ON WEIGHTS AND MEASURES 23 AUGUST 1890, No. 7088, AND TO ARTICLE V OF ORDER No. 334/1948 WHEREAS it is deemed advisable to amend the Consolidated Text of Laws on weights and measures as well as Article V of Order No. 334/1948, in that part of the Free Territory of Trieste administered by the British-United States Forces, NOW, THEREFORE, I, SIR JOHN WINTERTON, KCMO, CB, OBE, Major General, Zone Commander, ORDER: ARTICLE I Article 31 of the Consolidated Text of Laws on weights and measures, approved' by R. D. 23 August 1890, No. 7088, is hereby repealed and substituted by the following: „There shall be punished: 1. With a fine („ammenda“) from 5,000 Lire up to 20,000 Lire, any person placing on sale or on trade weights, measures and weighing and gauging instruments without the first verification stamp ; 2. with a fine („ammenda“) from 1,000 Lire up to 10,000 Lire : a) any person failing to fulfil the obligation of the periodical verification prescribed by article 16 ; b) any person failing to re-legalize renewed weighing and gauging instruments, both ordinary and automatic ; c) any person failing to request the inscription concerning the status of users in terms of article 19, third paragraph ; 3. with a fine („ammenda“) from 1.000 Lire up to 10,000 Lire, any person contravening the provisions of those Laws on weights and measures and relative Regulations which do not provide for any special penalty ; 4. with a 4,000 Lire fine („ammenda“), any Notary or Public Official contravening the provisions of articles 9, 10 and 11 and with a 2,000 Lire fine („ammenda“), any private citizen committing same contravention.
