WINTERTON Major General Ref. : LD/A/53/109 Zone Commander Order No. 114 GRANTING OF EXTRAORDINARY UNEMPLOYMENT SUBSIDY IN FAVOUR OF SEAMEN INVOLUNTARILY UNEMPLOYED AND DISCHARGED WHEREAS it is considered advisable to grant an extraordinary unemployment subsidy in favour, of seamen involuntarily unemployed and discharged, in that part of the Free Territory of Trieste administered by the British United States Forces, NOW, THEREFORE, I, SIR JOHN WINTERTON, KCMG, OB, CBE, Major General, Zone Commander, ORDER: ARTICLE I The granting of the extraordinary unemployment subsidy set forth in Order No. 196, dated 7 October 1949, is hereby authorized for the duration of 90 days in favour of seamen in possession of the „libretto di navigazione“, involuntarily unemployed owing to lack of work on the effective date of this Order and discharged for reasons not depending upon their own will provided, however, they are in the conditions required by said Order to benefit by the mentioned extraordinary subsidy. In case of discharge caused by sickness, seamen shall — without any prejudice to the conditions set forth in the foregoing paragraph — be admitted to said extraordinary subsidy whenever, on the effective date of this Order, they have already benefitted by sickness-assistance by the competent „Cassa Marittima“ for a period of not less than sixty days. The extraordinary subsidy referred to in the foregoing paragraphs shall be due as from the first day (excluding holidays) subsequent to that on which the application by the unemployed worker has been filed with the „Capitaneria di Porto“. The „Capitaneria di Porto“ shall forward the applications to the „Istituto Nazionale della Previdenza Sociale“ together with a certificate stating the reason why the applicant has interrupted his work as well as attesting that at the time of the application said applicant is not employed on board again and that he is inscribed in the seamen’s priority lists („turni di colloeamento“). The time-limit for the filing of the applications shall expire on the fortyfifth day after the publication of this Order in the Official Gazette. ARTICLE II There shall be excluded from the granting of the subsidy those persons who are inscribed in the nominal rolls of agricultural workers as set forth in art. 12 of R. D. 24 September 1940, No. 1949, except those workers inscribed in said rolls in the category of temporary workers („eccezionali“) and having — for the purposes of the granting of family allowances — the qualification of head of family. ARTICOLO 2 L’articolo 3 del lodo pubblicato con l’Avviso n. 59 sulla Gazzetta Ufficiale dd. 21 dicembre 1951 (richiamato in vigore dal presente lodo) s’intende sostituito dall’articolo che segue : A partire dal 1° agosto 1953 gli scatti di anzianità, sempre nella misura di otto biennali per il personale impiegatizio e cinque triennali per il personale non impiegatizio, saranno calcolati nella misura del 2.5% per il personale impiegatizio e del 4% per il personale non impiegatizio, commisurati sullo stipendio o paga base, aumentati dell’ indennità di contingenza in atto al momento della maturazione del rispettivo scatto. Tale comma troverà applicazione al maturarsi del primo scatto successivo al 1° agosto 1953. Per quel che concerne invece gli scatti già maturati a tale data, essi saranno immediatamente ricalcolati nella misura prevista dal presente articolo, prendendo per base lo stipendio o la paga aumentati dell’ indennità di contingenza, in atto 1’ 1 agosto 1953. Sarà considerata legittima una richiesta di revisione anteriore alla scadenza prevista all’articolo 1, solamente nel caso in cui avesse a subire delle modificazioni il trattamento economico del personale disciplinato dal relativo contratto di categoria.
