D. 18 August 1940, No. 1741 : „ Should the requisition cease before the agreed or postponed expiration of the contract, „the party who had the use or enjoyment of the requisitioned property, shall again be entitled „to such use or enjoyment till the agreed or postponed termination of the contract on the same „conditions as previously, subject to any legal changes which may have intervened.“ ARTICLE II This Order shall become effective on the date of its publication in the Official Gazette. WINTERTON Major General Ref. : LD/ A/52/ 214 Zone Commander Order No. 11 ESTABLISHMENT OF AN ADVISORY COMMISSION FOR ANTIQUES, FINE ARTS AND LANDSCAPES WHEREAS it is deemed advisable to establish an Advisory Commission for Antiques, Fine Arts and Landscapes, in that part of the Free Territory of Trieste administered by the British-United States Forces ; NOW, THEREFORE, I, SIR JOHN WINTERTON, KCMG, CB, CBE, Major General, Zone Commander, ORDER: ARTICLE I An Advisory Commission for Antiques, Fine Arts and Landscapes (hereinafter referred to as the „Commission“) is hereby established at the Education Office, Allied Military Government. ARTICLE II The Commission shall be composed of seven members, to be appointed by the Chief, Education Office, one for archaeology, palaeontology and ethnography ; two for mediaeval and modern art ; two for monumental buildings, town-planning („urbanística“) and natural beauties ; two for contemporary figurative arts. ARTICLE III The Chairman of the Commission shall be appointed by the Chief, Education Office, from amongst the Commission members. ARTICLE IV The Commission shall be convened whenever the Chief, Education Office, intends to submit for examination general or particular matters concerning antiques, fine arts and landscapes or measures of a technical nature, for which the opinion of the appropriate section of the Superior Council for Antiques and Pine Arts is prescribed. ARTICLE V At least five Commission members must be present to validate any decision of the Commission. ARTICLE VI The Commission members shall hold office for two years and may be re-appointed only for the subsequent two-year period. Members leaving office during the two-year period shall be replaced, for the remaining part of such period, by other members appointed in the manner outlined in Article II, above. ARTICLE VII Those members who are directly or indirectly interested in the matters submitted to the Commission for opinion shall abstain from taking part in the Commission’s work until the impediment ceases. They shall be temporarily replaced by deputy members appointed by the Chief, Education Office, for the duration of such impediment. ARTICLE VIII The Chief, Education Office may, upon hearing the Commission, attach to same, for certain matters, one or more external members. Attached members shall not be entitled to vote. Furthermore, the opinion of the Superintendent of Monuments, Galleries and Antiques may be requested for information. ARTICLE IX The burdens relative to the functioning of the Commission shall be charged to an appropriate fund to be inserted in the budget of the Superintendence of Monuments, Galleries and Antiques of Trieste. Directorate of Interior, is hereby authorized to perform, up to 31 December 1955, in conjunction with the relative Administrations, the surveys provided for by Order No. 166, dated 1 September 1950. Army Ref. : LDfAf53llO Acting Zone Commander Order No. 13 HOUSING DEVELOPMENT BOARD AMENDMENT TO ORDER No. 26/1951 WHEREAS it is deemed .advisable to modify the Housing Development Board, provided for by Order No. 26 dated 7 February 1951, as amended by Order No. 131 dated 26 July 1951, in that part of the Free Territory of Trieste administered by the British-United States Forces, NOW, THEREFORE, I, WILLIAM B. BRADFORD, Ma,or General U. S. Army, Acting Zone Commander, ARTICLE I Article XI of Order No. 26 dated 7 February 1951, as amended by Order No. 131 dated 26 July 1951, is hereby repealed and the following new Article XI substituted therefor : „For the purpose of controlling the expenditure of the Housing Development Fund, „a Board is hereby established as follows : a) the Chief of the Department of Public Works & Utilities or a person delegated by him — President b) a representative of the Avvocatura dello Stato — Vice President c) a representative of the Directorate of Interior d) a representative of the Zone President’s Office e) a representative of the Department of Finance f) a representative of the „Ispettorato Generale del Genio Civile e U. S.V.S. “ g) a representative of the „Ordine degli Ingegneri“ h) a representative of the „Ordine degli Architetti“. The members of the Board shall be appointed by Allied Military Government and shall hold office for two years. The presence of at least four .members of the Board shall be necessary for the decisions to be valid. The decisions shall be taken by a majority of votes. In ease of equal number of votes the President’s vote shall prevail. The decisions ol the Board shall be enforced by the Chief, Department of Public Works and Utilities. The Board shall be assisted by a technical secretariate which shall also be entrusted with the preliminary inquiry on the applications and general examination tasks. The functions of secretary shall be performed by an official of the Department of Public Works and Utilities designated by the Chief of said Department“.
