CORRESPONDENCE : Directorate of Legal Affairs, Gazette Office, A.M.G., Trieste. ?RICE: SALE: ALLIED MILITARY GOVERNMENT British- United States Zone-Free Territory of Trieste Order No. 119 AMENDMENTS TO THE ROAD CODE RELATING TO THE PHYSICAL AND MORAL REQUISITES OF MOTOR - VEHICLE DRIVERS WHEREAS it is considered advisable to make certain amendments to the Consolidated Text of laws for the safeguard of roads and for circulation, approved by R.D. 8 December 1933, No. 1740 (Road Code), concerning the physical and moral requisites to be possessed by persons intending to obtain driving licem es as well as by holders of same licenc es during the revision stage, in that part of the Free Territory of Trieste administered by the British-United States Forces ; NOW, THEREFORE, I, SIR JOHN WINTERTON, KCM6, CB, CBE, Major General, Zone Commander, ORDER: ARTICLE I The amendments set forth in the subsequent Articles are hereby made to the Consolidated Text of laws for the safeguard of roads and for circulation, approved by R.D. 3 December 1933, No. 1740. ARTICLE II The second paragraph of art. 83 is hereby repealed and substituted by the following: „The application must be supported by a medical certificate, antedated no longer „than three months and issued by the Sanitary Inspector of the State Railways or by „the Public-Health Officer of the Commune of residence or by Medical Officers belonging „to the Medical Board for War Pensions. „In case of request for the issue of a certificate of fitness for a second grade driving „licence, the application shall be supported also by a general certificate of the Judicial „Records („Casellario giudiziale“) antedated no longer than three months.“ ARTICLE III The last part of the first paragraph of art. 85 bis, inserted after art. 85 in terms of Article III of Order No. 397, dated 10 December 1948, is hereby repealed and substituted by the following : „The application must be supported by a medical certificate as indicated in the „second paragraph of art. 83“. A.M.G. - F.T.T, Gazette — Vol. VI, No. 28 — 11 October 1953 395 Section 1. — The second paragraph of art. 86 is hereby repealed and substituted by the following : „As for the first grade drivig licence and the motor-cycle, motor-cycle with „side-car and light motor-van licence, the Inspectorate shall ascertain the moral fitness „of the applicant upon production of any document showing also the personal particulars, „the age and the residence“. Section 2. — The third paragraph of art. 86 is hereby repealed. ARTICLE V In the third paragraph, letter (c), of art. 83, and in the third paragraph of art. 91, the word „Snellen“ is hereby substituted by the word : „Monoyer“. ARTICLE VI Article 84 is hereby repealed and substituted by the following : „The following persons cannot be admitted to the qualifying examination mentioned „in arts. 86 and 87 : „1) those who have been convicted of a crime against property punishable with a penalty „restricting personal liberty for not less than three yeais’ imprisonment in the minimum „or those who prove to have been declared habitual delinquents, professional delinquents or delinquents by tendency or who, however, are undergoing personal administrative measures of safety ; „2) those who have been sentenced at least twice to a penalty restricting personal liberty „of the duration of not less than two years for any culpable crime („delitto colposo“). „The indignity shall cease with the repeal of the personal administrative measures : „of safety or with rehabilitation.“ ARTICLE VII The last paragraph of art. 85 is hereby repealed. ARTICLE VIII Paragraph 1st of art. 95 is hereby.repealed. ARTICLE IX The following third paragraph is hereby added to art. Ill : „All driving licences issued upon authority granted in* terms of numbers 1) and „3) of the second paragraph hereof shall be valid for the year of issuance and for the „subsequent four years, save renewal according to the same rules as set forth herein.“ L''"‘ The foregoing provision shall apply also to licences already issued prior to the effective date of this Order. For the purposes of revision of motor-vehicle driving licences, the following shall be admitted in derogation of the provisions of art. 91 : a) that drivers furnished with a first grade licence and motor-cycle licence hear a conversation voice from a distance of eight metres altogether and of not less than two metres, as for the ear which hears less ; b) that drivers furnished with a second grade licence hear a conversation voice from a distance of eight metres from each ear ; e) that drivers furnished with a third grade licence, instead of the requisites set forth in the third paragraph of art. 91, possess the requisites set forth under letter (c) of the third paragraph of art. 83. However, said drivers cannot drive motor-buses on public service lines or garage hire-buses („noleggio da rimessa“) or trucks and trailers fitted with continuous brake ; this must be annotated on the driving licences. WINTERTON Major General Ref. : LDIAI53I104: Zone Commander Order No, 120 TARIFF RATES OF, AND CONTRIBUTIONS DUE TO „ASSOCIAZIONE GIULIANA PER IL CONTROLLO DELLA COMBUSTIONE“ FOR 1953 WHEREAS it is necessary to provide for modifications and amendments to the tariff rates and dues payable for the year 1953 to „Associazione Giuliana per il Controllo della Combustione“ within that part of the Free Territory of Trieste administered by the British-United States Forces (hereinafter referred to as the „Zone“), NOW, THEREFORE, I, SIR JOHN WINTERTON, KCMG, GB, CBE, Major General, Zone Commander, ORDER: ARTICLE I APPROVAL OF TARIFF RATES AND CONTRIBUTIONS FOR THE YEAR 1953 The „Associazione Giuliana per il Controllo della Combustione“ is hereby authorized to charge for the year 1953 the members („consortisti“) of its Association within the Zone the tariff rates and the contributions set forth in Tables „A“, ,,B“, ,,C“, ,,D“, ,,E“ and ,,F“ annexed to this Order. DEPOSITING OF TABLES The Tables „A“, ,,B“, ,,C“, ,,D“, ,,E“, and ,,F“ mentioned in the preceding Article, together with the annotation set out therein, shall constitute a part of this Order. A copy of such Tables shall be deposited at the Office of the Directorate of Interior, at the Office of the Zone President, and at the Office of the Association, where they may be inspected by the parties interested.
