Editoriale Libraria, Trieste - 1946 Allied Mili£ ary Government 13 CORPS General Order No. 43 SUPPLEMENTARY FAMILY ALLOWANCE AND RE-ARRANGEMENT OF EXISTING ALLOWANCES WHEREAS, it is deemed just and necessary under present conditions to grant an increase in the measure of Family Allowances and to enact other provisions applicable thereto, for that part of Venezia Giulia administered by the Allied Forces (hereinafter referred to as the Territory“), NOW, THEREFORE, I, ALFRED C. BOWMAN, Colonel, J.A.G.D.; Senior Civil Affairs Officer, hereby • ORDER: ARTICLE I- SUPPLEMENTARY COST OF LIVING BONUS Section 1. —'A supplementary cost of living bonus in the amounts and under the conditions set forth in the Tables annexed to this Order and marked A, B, C, D, and E, is hereby granted to workers within the Territory entitled to Family Allowances in* accordance with the provisions of R.D.L. 17 June 1937, No. 1048, converted with amendments into the Law of 25 October 1938, No. 2233, and with the provisions of the Law of 0 August 1940, No. 1278. Section 2. — Such supplementary bonus shall be paid with effect from 1 August 1945. ARTICLE II ABOLITION OF THE CLASSIFICATION OF FAMILIES BASED ON THE NUMBER OF CHILDREN, AND ESTABLISHMENT OF REVISED AMOUNTS FOR THE ORDINARY FAMILY ALLOWANCES Section 1. — The classification of families based on the number of children or other dependents in the same category for the purpose of determining the amount of the Family Allowances due in respect of each child, is hereby abolished. All provisions of existing Law providing for such classification are hereby accordingly repealed. Section 2. •—- The individùal amount of the ordinary family allowances in respect to each child and other dependent shall be in accordance with the Tables referred in Section 1 of Article I of this Order which shall be in substitution of all other Tables now in effect. Section 3. — Articles 13, 15 and 16 of the Law of 6 August 1940, No. 1278, regarding the allocation to the Cassa ünica of the Family Allowances due to the staffs of the State Administrations and other Public Bodies, shall not be effected by this Order. Section 4. ■—- All the provisions of this Article shall.be effective as from 1 August 1945. ARTICLE III FAMILY ALLOWANCES FOR PARENTS DEPENDENT UPON BENEFICIARY Section 1. — Family Allowances for parents in accordance with Article 3 of the Lav of 6 August 1940, No. 1278, shall be due to all categories of workers provided that the parents are dependent upon such workers. Authority already granted as to the right to such allowances shall remain in force until expiration. Section 2. —- A parent shall be considered to be dependent upon a Worker if the following conditions exist : • a) If living together ; b) If the'father is over 60 years of age and the mother is over 55 years of age, or if the parents are recognized as permanently incapacitated from any remunerative work in accordance with the regulations of compulsory insurance against disability'* and old-age ; ■ c) If the income of both parents from all sources does not exceed L. 1.000 monthly, or when there is one parent, his or her income does not exceed L. 600 monthly ; d) If the worker’s support of one or both parents is both continuous and adequate ; e) If the father of such worker is not receiving a family allowance in respect of the mother. Section 3. —• Parents shall be considered as Jiving with the worker if their names appear on the same Family status at the General Registry Office even when the worker is employed away from his permanent place of residence. Section 4. —• When more'than one worker of the family contributes to the support of the parents, the appropriate Family Allowance shall be due to one only. In the event of disagreement among the members of the family in this respect, the allowance sh 11 be paid to the oldest s*»n. •ARTICLE IV FAMILY ALLOWANCES FOE OTHER ASCENDANTS IN DIRECT LINE Section 1. — The right of the worker to Family Allowances in respect of his father is extended to the ascendants (ascendenti) in the direct line of his father provided the worker is entitled to receive the allowance in respect to such father or if the father is dead, and further provided that the conditions stated in Article III of this Order exist. Section 2.,-—•' The same right shall exist in respect to the ascendants of the mother under the same conditions stated in the preceding Section. Section 3. — The Family Allowance shall be payable in respect to either or both lines of the ascendants referred to in the preceding Sections. ARTICLE V LIMIT OF EMPLOYEES’ MONTHLY EARNINGS FOR THE PURPOSE OF FIXING CONTRIBUTIONS The limit of the employees’ monthly earning for the purpose of fixing contributions as set forth in R.D., 21 October 1941, No. 1277, for commerce, professions and arts, and agriculture, and by collective contract of 20 May 1940 for Industry, is hereby increased to L. 3.000 monthly. ARTICLE VI EXTENSION OF ORDINARY ALLOWANCES AND COST OF LIVING BONUS TO THE MEMBERS OF DOCK-WORKERS COMPANIES Section 1. —• The Dock-Workers Companies which were exempted as of 1 May 1945, from observing the regulations in force as to Family Allowances, shall comply such regulations with effect from 1 August 1945, in accordance with this Ordér and Table A annexed hereto. Section 2. — The contributions shall be borne entirely by the Dock Companies and shall amount to 18% of the gross earnings, corresponding to the double rates of the contributions set forth in Article 44 of R.D. 21 July 1937, No. 1239. ARTICLE VII EFFECTIVE DATE OF ORDER Except as otherwise herein specifically stated, this Order shall become effective on the date that it is signed by me. ALLIED MILITARY GOVERNMENT 13 CORPS Order No.- 68 AMENDMENT TO GENERAL ORDER No. 20— RE-ORGANIZATION OF THE PROFESSIONS WHEREAS, General Order No. 20, entitled, „Re-Organization of the Professionsdated 20 October 1945, provides, among other things, as follows (Article XIV, Section 1) : „•Section 1. -— Nothing in this Order shall be construed to invalidate or change any of the provisions of General Order No. IS relative to the Epuration of the Professions except as provided in this Article. An Order of suspension made by a Profession Epuration Commission shall during the term of the suspension deprive the person of the right to hold any office herein created and' to practise the Profession“. BOWMAN, Colonel, J.A.G.D., Senior Civil Affairs Officer ALLIED MILITARY GOVERNMENT 13 CORPS Order No. 75 PAYMENT OF A CHRISTMAS BONUS TO PUBLIC EMPLOYEES AND PENSIONERS WHEREAS it. is considered desirable that a Christmas bonus be paid to public employees and, pensioners in those parts of Venezia Giulia administered by the Allied Forces (hereinafter1 referred to as „the Territory“), ' NOW, THEREFORE, I, H.P.P. ROBERTSON, Colonel. O.B.E., Acting Senior Civil Affairs Officer ORDER ARTICLE I GRANTING OF CHRISTMAS BONUS TO PUBLIC EMPLOYEES 1. •— A Christmas Bonus shall be granted, in the measure indicated in Article II, to all Public Employees serving in the Territory. 2. —■ The term „public employees“ shall include all permanent and temporary public functionaries and employees, state, parastate, provincial and communal, teaching or nonteaching personnel of the schools or „Istituti d’ Istruzione Media“, and employees of all other public bodies and organizations. 3. — Personnel referred to in para 2 above who receive the 13th month grant or similar compensation are excluded from the payment of the Christinas Bonus. The public employees to whom any special payment, has been made as Christmas or Year-end bonus or subsidy, shall receive only the difference between the Christmas Bonus authorized in para 1 and any such previous payments. « 4. —v For temporary and permanent state salaried personnel the Christmas Bonus shall gUbstitute the 53rd week payment. 5; •—- State dependents in military service, including war prisoners and internees and personnel „in aspettativa“ for health reasons or on extraordinary leave for the same reasons, are entitled to the Christmas Bonus. . ARTICLE II AMOUNT OF THE CHRISTMAS BONUS FOR THE PUBLIC EMPLOYEES 1. — The Christmas Bonus shall be paid at the gross amount of 3.000 lire for the personnel employed in the Communes of Trieste, Gorizia and Pola and at the gross amount of 2.500.— life for personnel emplhyed in the other Communes of the Territory. . 2. —• The amounts referred to in Section 1 this Article are payable in full to the personnel who at the date of 31 December 1945 had served fora period of six months. They are payable at the rate of 1/6 for each month served "during the period 1 July - 31 December 1945. Fractions of one month shall be computed as an entire month. ARTICLE III PUBLIC EMPLOYEES EXCLUDED FROM PAYMENT OF THE CHRISTMAS BONUS 1. ■—- Personnel whose salary, wa^e or ofher compensation, is under reduction or suspension are excluded from the payment of the Christmas Bonus. 2. — The Christmas Bonus shall not be paid to public employees who have been finally dismissed or suspended by an Epuration Commission established under General Order No. 7 after hearing of:'objections. Those who have been suspended or dismissed provisionally shall not receive the Christmas Bonus until and unless a final decision is rendered by such Epuration' Commission sustaining the objections to the provisional dismissal or suspension in accordance with such General Order. ARTICLE V CHRISTMAS BONUS TO PENSIONERS 1. —• A Christmas Bonus, amounting to gross 1.000»—lire, is granted to the pensioners receiving, at the date of 31 December state ordinary pensions, either direct orindiiect, including privileged pensions; life or temporary, or renewable allowances at the charge of the State, or of the Fund for the pensions of the State Railway or at the charge of the railway Administration. 2. — Tne Christmas Bonus referred to in Section 1 this Article is also due to the pensioners who receive, at the date of 31 December 1945, a pension at the charge or partial charge, of Istituti di Previdenza administered by Cassa Depositi & Prestiti. 3. —- The Christmas Bonus is not due to pensioners who are rendering paid services ,as dependents of the state or of other public bodies in connection with which they are receiving the Christmas Bonus referred to in Article I. 4. — Tnose pensioners who receive more than one pension shall receive the Christmas Bonus only once. ARTICLE V BUDGET CHARGE OF THE EXPENDITURE DERIVING FROM THE PAYMENT OF CHRISTMAS BONUS The Christmas Bonus will be chargeable to the .salary and wage items of the various budgets. Area, Order X. 36 is therefore amended as follows : a) The provisions of Article I., Section 2 (c) are hereby extended to bakers. In other words there is no restriction on their use of current. b) Trieste Area will be divided into two zones. •In the first of these zones the current will be switched off at the source between 0800 hrs and 1100 hrs each week day and in the second between 1315 and 1615 hrs. Both zones on Sunday will have current switched off between 1315 and„1515 hrs only. c) In various parts of Trieste Area, current will be switched off at the source from 1700 hrs to 2100 hrs for one day each week excluding Saturday and Sunday. The entire Area will be covered during the week by the switch-off. Additional police will be on duty in those parts where the current is lacking. d) Big Industry, which draws its supply direct from SELVEG as opposed to drawing it from ACEGAT will suffer the equivalent of a cut of one complete working day per week. In the majority of cases this will be enforced by switching off at source ; but there will be variation from this in certain cases. Getails will be issued by SELVEG to the industries concerned. e) All shops, offices, commercial or industrial enterprises and workshops who draw their supply from ACEGAT will cease to use electricity at 1700 hrs each day. This provision will not be enforced by cuts at source, it must be done by the consumer himself ; but the police have been given orders vigorously to enforce this order. f) Area Order N. 36 will remain in effect except as amended herein. Section 3. ~ Under the terms'of Section 1 of this Article, electrical current will not be cut off at the source. It will be an individual responsibility to conform to the requirements of Section 1, and the Police will effect whatever patrols necessary to ensure compliance. ARTICLE III. The Area Commissioner reserves the right to revise or alter any of the Provisions of this Order by a. written notice published in. the newspapers. ARTICLE IV.
