La Ediforiale Libraria, Trieste - 1948 ALLIED MILITARY GOVERNMENT British - United States Zone-Free Territory of Trieste Order No. 226 TERMINATION OF THE WAR LAW AND TRANSITION FROM WAR LEGISLATION TO PEACE LEGISLATION WHEREAS it is considered advisable to terminate the War Law and other provisions connected with the state of war loithin that Zone of the Free Territory of Trieste administered by the British-United Stat s Forces (hereinafter referred to as the „Zone“), NOW, THEREFORE, I, RIDGELY GAITHER, Brigadier General U. S. Army,'Director Generai; Civil Affairs, ORDER: ARTICLE I TERMINATION DATE OF THE WAR LAW Except, as hereinafter provided, the War Law approved by R. D. 8 July 1938, No. 1415, and subsequent amendments thereto shall cease to be applied in the Zone as from the ninetieth day from and after the effective date of this Order. ARTICLE II REPEAL OF THE APPLICATION OF PROCLAIMED AND STATUTORY LISTS ISSUED BY UNITED NATIONS Article IV of General Order No. 35 dated 25 January 1946 issued by Allied Military-Government of Venezia Giulia forbidding correspondence with any firm or private person included in the Proclaimed and Statutory List of prohibited firms and persons issued by the United Nations, is hereby repealed. ARTICLE III TERMINATION OF PROVISIONS AND DEEDS OF TEMPORARY NATURE Section 1. — (a) All legal provisions and administrative or judicial deeds being of a temporary nature because they refer to the duration of hostilities or state of war shall cease to have effect within the Zone as from the d.ate fixed by Article I hereof, subject to the further period of effectiveness as set out in the said provisions and deeds, which further period shall run from the date fixed by Article I hereof. (b) All other time limits fixed in relation to the termination of hostilities or of the state of war, shall run from the said date fixed by Article I hereof. Section 2. — All time limits, provided for in legal provisions or in administrative and judicial deeds however expressed fixed with reference to the Peace Treaty or to the conclusion of peace, shall be construed as referring to the date set forth in Article I hereof. Section 3. — The provisions of the foregoing Sections shall apply also to legal acts and documents made by private persons unless a different intention appears from the ‘acts and documents. ARTICLE IV EXEMPTIONS AND RESERVATIONS FROM THE APPLICABILITY OF THIS ORDER Section 1. — The provisions of Chapters II and III of Title V of the law referred to in Article I of this Order and subsequent provisions including penal provisions (regarding the treatment of enemy assets and the economic relations with the enemy state and persons of enemy citizenship) shall so far as it concerns private persons and corporation belonging to the states indicated in Order No. 53' dated 3 January 1946 issued by Allied Military Government of Venezia Giulia continue to apply within the Zone after the date set forth in Article I hereof. Section 2. — The provisions of R. D. No. 1741 dated 18 August 1940 (concerning the requisitioning of immovable and. movable property, establishments, etc.) and the provisions of Law No. 827 dated 27th June 1942 (concerning the conditional release of persons condemned to imprisonment for a period not exceeding five years) shall continue to apply within the Zone after the date set forth in Article I hereof. Section 3. — The provisions contained in Section 1 of this Article shall not apply to Austria. Section 4. — Allied Military Government reserves the right, at any time, to extend the time limits fixed by this Order or any othei Order or law affected or referred to by this Order, of any Order or Law which it is deemed necessary should be continued and excluded from the effects of this Order. Army Director General, Civil Affairs DECLARATION OF PUBLIC UTILITY CONSTRUCTION OF AQUEDUCT OF THE HIGHLAND OF TRIESTE WHEREAS, the expropriation of certain lands along the Highland of Trieste, in that Zone administered by the British- United States Forces, for the purpose of the construction or an aqueduct is deemed and. considered, to be of urgent necessity and of Public Interest, and WHEREAS the project for the construction of the Aqueduct, prepared by the Genio Civile has been approved by Allied Military Government, NOW, THEREFORE, I, RIDGELY GAITHER, Brigadier General U. S. Army, Director General, Civil Affairs, ORDER: ARTICLE I DECLARATION OF PUBLIC UTILITY Section 1. — - By the terms of this Order, the expropriation of grounds necessary for the construction of an Aqueduct on the Highland of Trieste as appearing on the Project prepared by the Genio Civile No. F.T.T. 241, is hereby declared to be of urgent necessity, and of Public Utility and interest. Section 2. — The said, grounds required for the construction of the Aqueduct are more specifically described in the Project prepared by the Genio Civile and approved by Allied Military Government, , Section 3. — The declaration aforementioned shall be given and have all the effects of laws in force on 8 September 1943. ARTICLE II EFFECT AND DEPOSIT OF PROJECT The project for the construction of the said Aqueduct shall be deposited in the Public Works Office of Allied Military Government and in the Office of the Genio Civile, and may l e freely examined by all persons concerned. . Army Director General, Civil Affairs AMENDMENTS TO DAWS RELATING TO EVICTIONS-ORDER No. 481 AND AREA ORDER No. 6 C ' WHEREAS it is deemed nececsaiy to amend existing laws and regulations relating to evictions from premises in that Zone of the F,ee Territory of Trieste administered by the British-United States Forces, NOW, THEREFORE, I, EIEGELY GAITHER. Army, Director General, Oivil Affairs, ORDER: ARTICLE I AMENDMENT OF ORDER No. 481 Article I of Order No. 461'dated 8 September 1947 is hereby amended as follows: a) That part of the last paragraph in the said Article reading „a period, of 6 months“, is hereby amended to read, „a period of 12 months“. b) The following section is hereby added: „Should the*Area President be notified by the Housing Office that suitable alternative accommodation is available for allotment to the tenant prior to the eviction date already fixed, then the said Area President may order the eviction to become effective within 14 days of the date of notification to the tenant of allotment of such alternative accommodation.“ ARTICLE II AMENDMENT OF AREA ORDER No. 6 C Paragraph a) 5, Section 2, Article. VI of Area Order No. 6 C, dated 4 October 1946 is hereby amended to read as follows : „5) Due to a sentence of a Court evicting them ; provided that such séntence was not issued on grounds of immorality or non-payment of rent.“ ARTICLE III EFFECTIVE DATE This Order shall become effective on the date of its publication in the Official Gazette. Army, Director General Civil Affairs, ORDER: ARTICLE I APPROVAL OF TARIFF RATES AND CONTRIBUTIONS FOR THE YEAR 1948 The Associazione Giuliana per il Controllo della Combustione is hereby autho ized to charge for the yeai 1948, the members (eonsortisti) of its Association within the Zone the taiiff rates and the contributions set forth in Tables „A“, ,,B“, „0“, ,,D“, ,,E“ and ,,F“ annexed to this Order. ARTICLE II DEPOSITING OF TABLES The Tables „A“, ,,B“, ,,C“, ,,D“, ,,E“ and ,,F'; mentioned in the preceding Article, together with the annotations set out therein, shall constitute a part of this Order. A copy of such Tables shall be deposited at the Office of the Department of Interior, at the Office of the Zone President, and at the Office of die Association, where they tony be inspected by the parties interested. Army Director General, Civil Affairs UTILIZATION OF RESOURCES CORPORATION WHERE AÏS, it is essential that all resources of the Free Territory of Trieste within the British-United States Zone which are now either non-productive or deteriorating in value, he exploited, developed, utilized and protected, I, RIDGELY GAITHER, Brigadier General U. S. Army, Director General, Civil Affairs, ORDER: 1. — There is hereby created a body corporate under the name „Utilization of Resources Corporation“ (heieinafter referred to as the „Corporation“). The principal office of the Corporation shall be located in Trieste, Free Territory of Trieste. 2. — The Corporation shall have capital stock of 1.000.COO lire, subscribed, for by Allied Military Government, British-United. States Zone, Free Territory of Trieste, through the Board of Finance and Economics, and payment for which shall be subject to call in whole or in part by the Board of Directors of the Corporation. 3. — The management,of the Corporation shall be vested in a Board of six Directors consisting of : The Deputy Chairman of the Board of Finance and Economics, Chairman The Chief of the Department of Industry The Chief of the Department of Commerce The Chief of the Department of Public Works The Director of Legal Affairs The Chief of the Department of Finance. 4. :— The Corporation shall not have succession beyond the existence of Allied Military Government, except for purposes of liquidation. The Corporation shall have power to prescribe, by its Board of Directors, rules and regulations governing the manner in which its general business may be conducted. The Board of Directors shall determine and prescribe the manner in which its obligations shall be incurred and its expenses allowed and paid. The Corporation, with the consent of any Department of Allied Military Government, may avail itself of the use of information, services, facilities, officers and employees thereof in carrjdng out the purposes cf this Order. The management shall use its best efforts to avoid any net loss on the aggregate of its operations. 5. — The objectives of the Corporation shall be to exploit, develop, utilize and protect and to assist in the exploitation, development, utilization and protection of, all properties and resources of the Free Territory of Trieste within the British-United States Zone, of every kind and description, which are now either non-productive or deteriorating in value ; and, in furtherance of Allied Military Government’s participation in the European Recovery Program, to develop all available of scrap metal. 6. — The Corporation is empowered (1) to take possession of, and direct and control, such statal and para-statal properties as may be designated by Allied Military Government and such other properties as may be designated by higher authority ; (2) to enter into contracts in furtherance of the objectives of the Corporation ; (3) to make loans or advances, on such terms and conditions and. with such maturities as it may determine to finance any such exploitation, development, conservation or protection as may be essential to its objectives ; (4) in case of property other than real property, which is, or may be, deteriorating to convert such property into cash provided other means of conserving the value are not practicable ; (5) to effect reorganization and, if necessary, liquidations ; (6) to use the proceeds from its operations in furtherance of its objectives. 7. — All moneys of the. Corporation not Otherwise employed may be deposited with the Department of Finance, Allied Military Government, subject to withdrawal on demand in accordance with the rules and regulations of the Corporation. 8. — The Corporation shall make a quarterly report to the Director General, Civil Affairs, of its activities and operations in such form and detail as may be required and' shall, on the order of the Director General, Civil Affairs, pay to Allied Military Government so much of the net proceeds resulting from its activities and operations as may, from time to time, be determined. 9. — This Order shall be in full force and effect from and after the date that it is signed by me. Army Director General, Civil Affairs Order No. 245 SUSPENSION OF DISMISSALS FROM INDUSTRIAL EMPLOYMENT — EXTENSION OF EXPIRATION DATE WHEREAS, it is considered necessary to amend Order No. 214 dated 27 March 1948, in order to extend its effectiveness for an additional period of one month, NOW, THEREFORE, I, RIDGELY GAITHER, Brigadier General, V. Army, Director General, Civil Affairs, ORDER: ARTICLE I That Section 1, Article 1 of Order No. 214 dated 27 March 1948, be and the same is hereby amended to read as follows : ..The expiration date, to-wit 31 March 1948, of Order No. 109 dated 17 January 1948, as amended by Order No. 172 dated 17 February 1948, is hereby extended up to and including 31 May 1948“. I employed by the firm CONAT and duly approved by the Department of Labour on April 19th, 1948 ; AWARD: The wage-scale at present in force for workers of the Mechanic Industry as provided for by the prescribed wage-agreement dated July 11th, 1947, together with the clauses connected therewith, shall be wholely applicable to the personnel employed by the firm CONAT.
