CARNES, Colonel Infantry, Senior Civil Affairs Officer, ORDER: ARTICLE I EXTENSION OF THE PROVISIONS SET FORTH IN ORDER No. 199 The time limits established in Articles III, V, VI and VII of Order No. 199 as amended by Order No. 285, dated 31 Jan. 1947, are hereby extended up to and including 31 December 1947. ARTICLE II AMENDMENTS TO THE DAILY ALLOWANCE Article III, Section 1 of Order No. 199 and amendments thereto set forth in Order No. 285, are hereby amended as follows : Personnel of grades nob below the sixth of the „Ordinamento gerarchico“ and personnel of corresponding grade in the State Railways .................... 40.— Lire Personnel of the seventh to the twelfth grades of the „Ordinamento Gerarchico“ and personnel of corresponding grades in the State Railways, temporary („non di ruolo“) or „assimilato“ personnel of 1st and 2nd category ............ 35.— Lire Personnel of the remaining grades of the „Ordinamento gerarchico“, personnel of corresponding grades in the State Railways, temporary („non di ruolo“) or „assimilato“ personnel of 3rd category...................................... 30.— Lire Subordinate („subalterno“) personnel either permanent („di ruolo“) or temporary („non di ruolo“), daily paid („salariato“) personnel, and the remaining permanent and temporary personnel of the State Railways and the pe sonnel of the State Telephone Services having the same status of the aforesaid State personnel 25.— Lire „Marescialli“ of Forces having a military organization ........................ 30.— Lire a military organization........................................................... 20.— Lire „Appuuteti“ and „Miiiti“ of the Civil Police and of Forces having a military organization...................................................................... 15.— Lire ARTICLE III PERSONNEL ENTITLED TO THE DAILY ALLOWANCE AND MOVING-IN ALLOWANCE The moving-in allowance and the daily allowance referred to in Article II and III of Order No. 199 as amended by Order No. 285, and this Order shall, subject to the condiciona provided for by the aforesaid Articles remaining unchanged, be due only to : a) to the personnel who, although serving in the centres referred to in Article I of Order No. 199 and amendments thereto set forth in Order No. 285. have their dwelling not farther than 5 km outside the perimeter of said centres ; b) to the personnel who, although they are not performing their duty within the aforesaid centres, were authorized to live there owing to the proved impossibility of finding accomodation in the place they are performing their duty, provided that such place is located not farther than 5 km outside the perimeter of the centre they live in. ARTICLE IV RIGHT OF PERSONNEL TO CHOOSE THE MOST FAVODRABLE TREATMENT Section 1. — The personnel referred to in Article V of Order No. 199 as amended by Order No. 285, may choose the most favourable treatment between the reimbursement of the travelling expenses provided for in the aforesaid Article, and the daily allcwfnce referred to in Article III of the same Order, at the rates therein established, or, as from 1 August 1946, at the rates laid down in Article II of this Order. Section 2. — From the benefit referred to in Article V of Order No. 199, as amended by Order No. 285, and, as a consequence, from the choice referred to in the preceding Section 1 of this Article, is excluded the personnel authorized to live in places other than the centres damaged pr;or to 11 June 1940. ARTICLE V EXTENSION OF BENEFITS TO PERSONNEL SERVING IN CENTRES OF WHICH AT LEAST 25% OF THE BUILDINGS ARE DAMAGED The Provisions referred to in Articles II, III and V of Order No. 199 as amended by Order No. 285, and by this Order, are applicable to personnel serving in centres having a population not exceeding 3000 inhabitants, in which at least 25% of the buildings used for dwellings were uninhabitable as at 1 January 1947 owing to distinctions caused by warlike operations. ARTICLE VI AMENDMENTS TO ARTICLE X OF ORDER No. 199 Article X, part D, of Order No. 199 and amendments thereto set forth m Order No. -285. is hereby, deleted and the following substituted in lieu thereof: ~ . „The provisions of this Order shall not be applied in favour of personnel on tem- „porary duty in the centres referred to in the preceding Article V or serving with the ..schools referred to in Article VI hereof. „The payment of the daily allowance refeired to in Article III, or the repayment ,,of travelling expenses referred to in Articles V and VI hereof, is, however, allowed „when the economic treatment granted to the personnel on temporary duty is discon-„tinued.“ ARTICLE VII INSTRUCTIONS CONCERNING PERSONNEL ENTITLED TO THE ALLOWANCE REFERRED TO IN ARTICLE II OF ORDER No. 199 Section 1. — The allowance referred to in Article II of Order No. 199 and amendments thereto set forth in Order No. 285, shall he payable to the personnel who have resumed or resume service or have been order ed or are ordered to take up service for the first time in the centres referred to in Article I of Order No. 199 as amended by Order No. 285, and Article V of this Order, during the period 8 September 1943 — 31 December 1947. Section 2. — All other provisions established by the aforesaid Article II of Order No. 199 as amended by Order No. 285, remain unchanged. ARTICLE VIII BENEFITS CHARGEABLE TO STATE BUDGET The granting of the benefits referred to in Order No, 199 as amended by Ordei. No. 285, and this Order, in favour of permanent and temporary personnel of all categories depending on Universities and Institutes of instruction of higher grade, shall be a charge against the State budget. ARTICLE IX TIME LIMIT FOR THE PRESENTATION TO INTENDENZE DI FINANZA OF STATEMENTS DELIVERED BY GENIO CIVILE In applying the provisions of Order No. 199 as amended by Order No. 285, and this Order to personnel serving in distressed centres, the certificates given by Genio Civile as'provided for in Article I of Order No. 199 as amended by Order No. 285, and Article V of this Order, shall be submitted to the Intendente di Finrnza not later than 90 days from the date on which this Order becomes effective. ARTICLE X EXTENSION OF THE PROVISIONS OF THIS ORDER TO THE PROVISIONS SET FORTH IN ORDER No. 342 The: provisions set. forth in this Order shall be ppplied also to the centres referred to in Order No. 342. DATE OF COMING INTO FORCE OF THE PROVISIONS OF THIS ORDER Articles III, IV, VI and VIII of this Order shall take effect as from 16 October 1945. Article II of this Order shall take effect as from 1 August 1946. Article V of this Order shall take effect as from 16 October 1946. ARTICLE XII *■ ■ / . CARNES Colonel, Infantry Senior Civil Affairs Officer Order No. 35 (110 B) UNIVERSITY OF TRIESTE INCREASE OF TAXES, SURTAXES AND FEES WHEREAS it is considered necessary to increase all taxes, surtaxes and fees payable, as fixed, for the University of Trieste; NOW, THEREFORE, I, JAMES J. CARNES, Colonel Infantry, Senior Civil Affairs Officer, ORDER: ARTICLE I All University taxes, surtaxes and fees payable as fixed for the University of' Trieste shall be increased 100% with effect from the commencement of the school-year 1947-1948. Infantry Senior Civil Affairs Officer 48 Order No. 36 (49 B) ADDITIONAL PROVISIONS CONCERNING STAMP DUTIES WHEREAS it is deemed necessary to issue additional provisions concerning Stamp duties in that Zone of the Free Territory of Trieste occupied by the British- United States Forces (hereinafter referred to as the „Zone“) NOW, THEREFORE, I, JAMES J. GARNES, Colonel Infantry, Senior Civil Affairs Officer ORDER: ARTICLE I With effect from 16 September 1947 the. stamp duty on bank drafts (vaglia cambiari) as provided in Art. 36 of Schedule „A“ attached to the Stamp Law R. D. L. 30 December 1923 No. 3268, shall be assessed on the basis of a declaration (accompanied by the three-monthly report) to be filed with the competent Registry Office in the Zone within 30 days from the last day of each quarter. The quarterly instalment shall be paid not later than 15 days after the filing of the declaration to the competent Registry Office of this Zone. ARTICLE II Finance Institutions having their head office outside this Zone may substitute the three-monthly report as provided in Art. 1 hereof and in Art. 12 of General Order No. 103, by a certificate of their head office stating the circulation of the respective bank drafts (assegni circolari ed assegni bancari) relative to their branches in this Zone. ARTICLE III This Order shall come in force on the date of its publication in the Official Gazette. Ilated at TRIESTE, 17th day of October 1947. JAMES J. CARNES Colonel. Infantry Senior Civil Affairs Officer Order No. 38 EXTENSION OF LEGAL OR CONVENTIONAL TERMS IN CASE OF CLOSING DOWN OF BANKS OWING TO EXCEPTIONAL EVENTS WHEREAS it is considered advisable and necessary to make provisions for cases when banks and institutes referred to in R. D. L. 12 March 1936, No. 375, and subsequent amendments, could not open to the public their depending offices, owing to exceptional events to be recognized as such by the Finance Division of the Allied Military Government by an appropriate Order, within that Zone of the Free Territory of Trieste occupied by the British-United States Forces (hereinafter referred to as the „Zone“) ; . NOW, THEREFORE, I, JAMES J, CARNES, Colonel Infantry, Senior Civil Affairs Officer, hereby ORDER: ARTICLE I 1. — In case that banks and institutes referred to in R. D. L. 12 March 1936, No. 376, and subsequent amendments, could not or cannot open to the public their depending offices, or some of them, owing to exceptional events to be recognized as such by the Finance Division of the Allied Military Government by an appropriate Order, the legal and conventional terms expiring during the period of such closing down shall be extended up to the second not festal day of resumption of work, if, owing to such closing, the operations which had to be effected within the aforesaid terms have not been carried out. 2. — The duration of the closing down shall be determined by an Order of the Finance Division of the Allied Military Government following a communication to be made by the single banks and institutes immediately after the re-cpening of their depending offices. ARTICLE II EFFECTIVE DATE This Order shall come into force on the day of its publication in the Allied Military Government Gazette. Dated at TRIESTE, this 17th day of October 1947. JAMES J.
