Trieste - 1947 Allied Military Governmenf VENEZIA GIULIA General Order No. 118 (16 H) COLLECTION OF CEREALS WHEREAS it is considered advisable and necessary to make amendments to General Order No. hi (61 G) dated 20th June 1947 containing provisions on the amassing of cereals harvested during 1947 in those parts of Venezia Giulia administered by the Allied Forces (hereinafter referred to as the „Territory“) : NOW. THEREFORE, I, JAMES J. CARNES, Colonel. Infantry, Senior Civil Affairs Officer, ORDER: ARTICLE I EXTENSION OF TIME LIMIT FOR PAYMENT OF PREMIUM FOR EARLY AMASSING The time limit established in General Order No. Ill (61 G) Art. VII, Section 2, for the payment of the premium of 400.- Lire for early amassing shall be extended from 31st July to 31st August. ARTICLE II AMENDMENT TO ART. Ill OF GENERAL ORDER No. Ill (61 G) The following Section 4 will be added to Art. Ill of General Order No. Ill (61 G), as a part of Art. II A): „Section 4 , a) Producers in the plain country shall complete the thrashing of wheat, rye and barley by 15th August 1947. b) Producers in hilly country shall complete the thrashing of wheat, rye and barley by 31st August. c) Producers who have not thrashed their cereals within the time limits above mentioned shall be denounced to the competent Allied Military Courts and shall be liable to the penalties as set forth in Art. Il, No. 23 - 1 August 1947 765 Order No. 414 REORGANIZATION OF ROLLS AND CAREER OF ELEMENTARY SCHOOL TEACHERS WHEREAS it is considered advisable and necessary to provide for. a reorganization of the rolls and career of elementary school teachers in that part of Venezia Giulia administered by the Allied Forces (hereinafter referred to as the „Territory“) NOW, THEREFORE, I, JAMES J. CARNES, Coknel Infantry, Senior Civil Affairs Officer ORDER: ARTICLE I REORGANIZATION OF ROLLS AND CAREER OF ELEMENTARY SCHOOL TEACHERS Section i. — The provisions of the Legislative Decree of the Provisional Head of the State, dated May 2, 1947, No. 499 (hereinafter called „said Decree“) issued by the Italian State, published in the Official Gazette No. 142 of June 25, 1947 and concerning the reorganization of the rolls and career of elementary school teachers, are hereby extended, by virtue of this Order, as far as applicable, to the Territory, with the exceptions and modifications mentioned in the subsequent sections, of this Article. Section 2. — Article 10 of the „said Decree“ shall be deleted and substituted by the following : „Art. 10“. The provision of Article 9 of the Law 1 June 1942. No. 675, concerning the distinction of principal and secondary seats is hereby repealed. ARTICLE II FINAL PROVISIONS Section i. — All references to the Italian State or to other bodies, Ministers or officials acting under its authority, contained in the „said Decree“ shall be considered as not existing and substituted by the words : „Allied Military Government, bodies and officials operating in the Territory under the control of the Allied Military Government; and nothing which is contained in the „said Decree“ may vest any authority on the Italian State, person or body operating under its authority, either with regard to persons or to properties existing in the Territory“. Section 2. — Copies of the „said Decree“ have been deposited in all Area Presidents’ Offices and in all „Sovraintendenze Scolastiche“ of the Territory and may be freely examined by all persons interested. ARTICLE III DATE OF COMING INTO FORCE AND DATE OF APPLICATION This Order shall come into force within the Territory on the day that it is signed by me and the provisions contained therein shall be effective as established by Article 7 of the „said Decree“. Gazette - Vol. II, No. 23 - 1 August 1947 Order No. 416 SUPPLEMENTARY CONTRIBUTIONS FOR SOCIAL INSURANCE FOR THE YEAR 1947 WHEREAS it is deemed necessary to modify for the year ig47 the rates of supplementary contributions in force in that part of Venezia Giulia administered by the Allied Forces (hereinafter referred to as the „Territory“) : NOW, THEREFORE, I, JAMES J. CARNES, Colonel, Infantry, Senior Civil Affairs Officer ORDER: ✓ ARTICLE I RATES OF SUPPLEMENTARY CONTRIBUTIONS FOR THE YEAR 1947 The supplementary contributions for social insurances due within the Territory for the year 1947, shall be, and are hereby fixed at the following percentages of the workers earrings, to be calculated in accordance with the provisions of General Orders No. 47 of 20 March 1946, and No. 68 of 23 -July 1946 : 1) 5.55% for workers subject to either compulsory insurance fori physical incapacity, old age and survivors insurance, or insurance under the Special Insurance Fund for personnel of the public transport services (Fondo Speciale di Previdenza per il personal© addetto ai pubblici servizi di trasporto) ; 2) 1.35% for workers subject to compulsory insurance under the Fund for the personnel of the Public Telephone Services (Fondo di Previdenza per il personal© addetto ai pubblici servizi di telefonia) ; 3) 0.80% for workers subject to compulsory insurance under the Fund for the personnel of the Consumer Tax Administrations (Fondo di Previdenza per il personals addetto alia Gestione delle Impost© di consumo) ; 4) 1.45% for workers subject to compulsory insurance under the Fund for the personnel of the Direct Tax Collecting and Receiving Agencies (Esattorie e Ricevitorie delle Imposts Dirette) ; 5) 4.60% for workers subject to compulsory insurance against involuntary unemployment ; 4/10 of such contribution to be used for the financing of the Extra-ordinary Unemployment Allowance established by Order No. 392 (103 C) dated 31 May 1947 ; 6) 4% for workers subject to compulsory insurance against tuberculosis. ARTICLE II REPEALING OF PROVISIONS OF PREVIOUS ORDERS All provisions of previous Orders, inconsistent 'with the provisions of this Order, are hereby repealed. Gazette - Vol. II, No. 23 - 1 August 1947 767 Order No. 418 (46 C) REORGANIZATION OF THE „CONSORZI AGRARI“ WHEREAS, it is considered advisable and necessary to make amendments to Orders No. 46 and 46 B, dated 26 November 1945 and 28 August 1946 respectively, which provide for the reorganization of the „Consorzi Agrari“ within those parts of Venezia Giulia administered by the Allied Forces (hereinafter called the „Territory“), NOW, THEREFORE, I, JAMES J. CARNES, Colonel, Infantry, Senior Civil Affairs Officer, hereby ORDER: x ARTICLE I AMENDMENT TO ARTICLE III OF ORDER No. 46 Section 1. — (a) of Article III of Order No. 46 shall be amended by adding to the first para thereof the following : „The 3 agricultural members of the Committee of Management of each Area Con-sorzio Agrario elected-or appointed shall belong to the categories of direct tenant farmers or agricultural workers with the qualification of metayers („mezzadri“) or share-croppers („coloni parziali“). Section 2. — The notice of convening the general meeting mentioned in the next to the last para of (a) Article III. Order No. 46, shall be published at least ten days before in two daily newspapers, one of them in the Italian and the other in the Slovene language, in place of the dailies „Giornale Alleato“ and „Glas Zaveznikov“ that have ceased their publication. Section 3. — The last para of (a) of Article III, Order No. 46, shall be amended to provide that the members of the Committees of Management shall hold office for one year instead of six months. The following shall be added to the last Section of (a) Article III, Order No. 46 : „The Committee of Management of each Area Consorzio Agrario shall meet at least once every four months.“ ARTICLE II AMENDMENT TO ARTICLE II OF ORDER No. 46 B The last sentence of Section 1, Article II, of Order No. 46 B is hereby repealed and shall be substituted by the following: „Further general meetings shall be convened whenever the Committee of Management consider it necessary to do so, but not less often than once every year. Each Committee of Management shall also convene the meeting without delay whenever it is being requested by so many members of the Consorzio as represent at least one fifth of its capital and the request mentions the points to be discussed“. GOTTARDO WHEREAS the Parish Church of S. Gottardo in Mariano del Friuli has presented a petition asking for permission to accept a gift of properties wade to the said Church by Mr. Francesco and Riccardo named Enrico Zanetti late Giuseppe and by their sister Caterina widow Zotti, in Mariano del Friuli respectively the last one in Ronchi dei Legionari; and WHEREAS the said petition has been duly approved in writing by the President of the Area of Gorizia; and WHEREAS there is no objection to the granting of such^ petition, NOW, THEREFORE, I, JAMES J. CARNES, Colonel, Infantry, Senior Civile Affairs Officer, ORDER: 1. — That the Parish Church of S. Gottardo in Mariano del Friuli be and is hereby authorized to accept the gift of property made to the said Church, by Mr. Francesco and Ric-cardo named Enrico Zanetti late Giuseppe and their sister Caterina widow Zotti ,as described in the deed of gift dated 17 March 1947 by the notary Carlo Mosetti and recorded in the Commune of Gradisca on the 2 April 1947, in accordance with the provisions contained in the above mentioned deed of gift and without prejudice to the rights of third persons. 2. — This Order shall take effect on the date that it is signed by me. CARNES Colonel, Infantry Senior Civil Affairs Officer Order No. 420 PERMISSION TO CHURCH OF SAN GIORGIO DI BRAZZANO TO EXCHANGE PROPERTY WHEREAS, the Parish Church of San Giorgio di Brazzano has presented a petition asking for authorization to exchange certain property owned by it for property owned by Mr. ZORZON Luigi fu Cesare Augusto and Mr. ZORZON Luigi fu Giovanni Battista of Brazzano ; and WHEREAS, the said petition lias been duly approved in writing by the Area President of the Area of Gorizia; and WHEREAS there appears to be no objection to the granting of such petition ; NOW, THEREFORE, I, JAMES J. CARNES Colonel' Infantry Senior Civil Affairs Officer Order No. 425 (225 A) ADDITIONAL PROVISIONS RELATING TO REQUISITIONS WHEREAS it is deemed advisable and necessary to amend Order No. 225 dated yth January 1947 which provides for payment in respect of motor vehicles requisitioned by the Allied Authorities in that part of Venezia Giulia administered by the Allied Forces (hereinafter referred to as the „Territory“), NOW, THEREFORE, I, JAMES J. CARNES, Colonel, Infantry, Senior Civil Affairs Officer, ORDER : ARTICLE I AMENDMENT OF ARTICLE VII, SECTION 3, OF ORDER No. 225 That sentence of Article VII, Section 3 of Order No. 225 which reads : „The value of each tyre shall be established by multiplying the 1940 list price of the vehicle by 4.25 and dividing by five (5)“ is hereby deleted and cancelled and is hereby substituted by the following: „The value of each tyre shall be established in conformity with the current price lists of Italian manufactured tyres. “ « ARTICLE II EFFECTIVE DATE This Order shall become effective on the date that it is signed by me. CARNES Colonel, Infantry Senior Civil Affairs Officer 770 A.M.G, Gazette - Vol. II, No. 23 - 1 August 1947 Order No. 426 (367 B) INCREASE IN „INDEMNITY FOR BREAD“ WHEREAS pursuant to Order No. 367, dated 31 May 1947, a temporary indemnity for increased price of bread has been granted to certain classes of pensioners and unenvployed workers which has been subsequently increased by Order No. 403 (367 A) dated 28 June 1947; and WHEREAS in consequence of a new increase in the price of bread, it is deemed reasonable and necessary to grant a further increase in the daily rate of the said temporary indemnity in that part of Venezia Giulia administered by the Allied Forces, NOW, THEREFORE, I, JAMES J. CARNES, Colonel, Infantry, Senior Civil Affairs Officer, ORDER: ARTICLE I INCREASE IN INDEMNITY As and from the date of this Order, the temporary indemnity for the increased price of bread as provided for by Order No. 367 dated 31 May 1947, shall be fixed at Lire 18.— per day. CARNES Colonel, Infantry Senior Civil Affairs Officer Order No. 428 PROVISIONS CONCERNING METAYER-SYSTEM RELATIONS WHEREAS, it is deemed advisable and necessary to apply the provisions of the Agreement concerning metayer-system relations hereinafter mentioned in that part of Venezia Giulia administered by the Allied Forces (and hereinafter referred to as the „Territory“), NOW, THEREFORE, I, JAMES J. CARNES, Colonel, Infantry, Senior Civil Affairs Officer A.M.G. Gazette - Vol. II, No. 23-1 August 1947 .771 ORDER: ARTICLE I PROVISIONS CONCERNING TRUCE IN METAYER SYSTEM RELATIONS Section i. — Subject to the modification set forth in Section 2 of this Article, the provisions of the „Agreement of truce in metayer-system relations“ dated 24 June 1947 concluded in Italy between the Italian Confederation of Agriculturers, the Association for the agrarian reconstruction and recovery, the National Confederation of the agricultural workers and the National Confederation of direct farmers (hereinafter referred to as the „said agreement“) shall be and is hereby extended to the Territory. Section 2. — Provision number seven of the said agreement is hereby deleted and substituted by the following : „Any controversy concerning the interpretation and implementation of the present agreement shall be referred to the Chief Officer of the Allied Military Government Agricultural Division for decision, without appeal, as arbiter in all disputes without being bound by fixed rules of procedure“. ARTICLE II FINAL PROVISIONS Section i. — All references to the Italian State and any Departments, bodies, Minister^ or Officials under its authority referred to in the said agreement shall be deemed to be deleted and in their place shall be substituted Allied Military Government and officials and bodies operating in the Territory under the control of Allied Military Government, and nothing contained in the said agreement shall confer any jurisdiction upon the Italian State or any person or body acting under its authority with any person or property existing in the Territory. Section 2. — Copies of the said agreement certified by the Chief Officer of the Allied Military Goverment Agricultural Division will be deposited at all offices of the Area Presidents and at the Communal Agricultural Statistic-Economic Offices (U.C. S.E.A.) in the Territory where they may be freely examined by all person* concerned. ARTICLE III EFFECTIVE DATE This Order shall come into effect in the Territory, on the date it is signed by me. Gazette - Vol. II, No. 23-1 August 1947 Order No. 429 EXTENSION OF TIME LIMITS FOR THE SALE OF CERTAIN PHARMACIES WHEREAS it is considered advisable and necessary to extend the time limits for the sale of •privileged and authorized pharmacies in that part of Venezia Giulia administered by the Allied Forces (hereinafter referred to as the „Territory“) : NOW, THEREFORE, I, JAMES J. CARNES, Colonel, Infantry ,Senior Civil Affairs Officer > ' V ORDER; ARTICLE I Section i. — The time limit provided for by Article 374 of the Consolidated Text of the Sanitary Laws, approved by R. Decree 27 July 1934, No. 1265, for expiration of the privilege granted to pharmacies under the former law, in accordance with Article 28 of the Law dated May 22, 1913, No. 468, is hereby extended up to six months after termination of the present state of war. Section 2. — a) The transfer of pharmacies considered by the preceding para may not take place, as from May 31, 1943 up to the expiration of the extension period, unless it be in favour of pharmacists duly inscribed in the professional Rolls. bj In case of succession, the transfer of the pharmacy may be accomplished in accordance with the second para of Article 369 of the Consolidated Text of the sanitary laws. c) The heirs of the owner may transfer the pharmacy in favour of pharmacists inscribed in the professional Rolls, in accordance with Article 2 of the Law 23 December 1940, No. 1868. Section 3. — The time limit established by Articles 2 and 3 of the Law 23 December 1940, No. 1868, shall, for the alienation on the part of heirs of the respective owners of authorized pharmacies considered therein, be extended for the same period. Gazette - Vol. II, No. 23-1 August 1947 773 Order No. 430 PROVISIONS CONCERNING LEASES OF FARM LANDS WHEREAS it is considered advisable and necessary to make provisions concerning leases of farm lands within that part of Venezia Giulia administered by the Allied Forces (hereinafter referred to as the „Territory“) : NOW, THEREFORE, I, JAMES J. CARNES, Colonel, Infantry, Senior Civil Affairs Officer, hereby ORDER: ARTICLE I PROVISIONS CONCERNING LEASES OF FARM LANDS - Section i. — With the exception and modifications provided for by^the following Sections of this Article, D.L.C.P.S. 1 April 1947, No. 227, published in the „Gazzetta Ufficiale“ of the Italian Republic, No. 102, dated 5 May 1947, and containing provisions concerning leases of farm lands (hereinafter referred to' as the „said decree“), is hereby extended to the Territory in so far as applicable. Section 2. — Article 1 of the „said decree“ is hereby rescinded. Section 3. — (a) The following words, contained in the first para of Article 3 of the „said decree“, are hereby deleted : „Whereas no change shall be made to the provisions of Article 1.“ (b) The second para of Article 3 of the „said decree“ is hereby rescinded and the following substituted in lieu thereof : „As to contracts where no agreement has been reached, an each party shall be authorized to apply to the District (Mandamento) Agricultural Commission, who shall decide thereupon by applying the principles established in Article I, Section 3, letter (b), of Order No. 141“. Section 4. — Article 4 of the „said decree“ is hereby rescinded. Section 5. — The reference to Article 1 of the „said decree“ contained in the first para of Article 5 thereof, is hereby deleted. Section 6. — Article 9 of the „said decree“ is hereby rescinded and the following substituted in lieu thereof : „Article 9. — The decision on disputes in connection with the subject matter of this decree, is hereby assigned to the District and Area Agricultural Commissions constituted pursuant to Article IV of Order No. 141, dated 3 June J1946 ; such Commissions shall exercise the powers and functions vested on them by the provisions of the said Article“. ‘ Section 7. — Article 10 of the „said decree“ is hereby rescinded. Section 8. — Article 13, 14 and 15 of the „said decree“ are hereby rescinded. 774 ■A.M.G. Gazette - Vol. II, No. 23 - 1 August 1947 Administrative Order No. 134 AUTHORIZATION TO NOTARY PIETRO F^LIPPUTTl FOR TEMPORARY EXERCISE OF HIS PROFESSION WHEREAS it appears that there is a vacancy in the Notarial District of Trieste, which it is advisable and necessary to fill; and WHEREAS said office is desired by Notary Pietro FILIPPUTTI, formerly exercising his profession at Pola, and regularly inscribed at the Notarial College of Trieste pursuant to the Decree of the First President of the Court of Appeal of Trieste dated July 15, ig46; NOW, THEREFORE, I, JAMES J. CARNES, Colonel', Infantry, Senior Civil Affairs Officer, hereby ORDER: 1. — Dr. Pietro FILIPPUTTI, is hereby authorized to temporarily exercise his profession of Notary in Trieste. 2. — The above mentioned Notary shall, within 30 days from the effective date of this Order, provide for its registration free of charge in accordance with Art. 18, No. 3 of the Law 16 February 1913, No. 89 ; he shall further comply with the other formalities set forth in Nos. 4 and 5 of said Article, and open an office in his temporary seat. 3. ■— Since the said Notary has already deposited the security required by Law for Notaries, he shall be exempted from any additional security for the temporary exercise of his profession granted to him by this Order. 4. — This Order shall take effect on the date that it is signed by me.
