ALLIED MILITARY GOVERNMENT British - United States Zone-Free Territory of Trieste Order No. 97 LIMITATION OF SPEED OF TRAFFIC ON COAST ROAD FROM TRIESTE TO THE FRONTIER (AMENDMENT TO ORDER No. 52/1949) WHEREAS it is considered necessary to amend Order No. 52 dated 8 March 1949 concerning limitation of the speed of traffic on the Coast Road from Trieste to the Frontier (highway No. 14), NOW, THEREFORE, I, SIR JOHN W1NTERTON, KCMG, CB, CBE, Major General, Zone Commander, ORDER: ARTICLE I Section 1. — Article I, Section 1, of Order No. 52 dated 8 March 1949 is hereby repealed and substituted by the following new Section 1 : „The entire coastal highway (No. 14) from Trieste through Barcola and San Gio-„vanni to the Posto di Bloceo on the Italian boundary of the Free Territory of Trieste „British-United States Zone, is hereby made subject to the speed limits specified in Section 2 hereof.“ Section 2. — Article I, Section 3 of Order No. 52 dated 8 March 1949 is hereby cancelled. WINTERTON Major General Ref. : LD/A/53/110 Zone Commander Order No. 98 INCREASE OF THE STATE CONTRIBUTION IN FAVOUR OF THE UNIVERSITY OF TRIESTE WHEREAS it is considered advisable to increase the State contribution in favour of the University of Trieste and the contributions for assistance to students and, further, to adjust the University taxes and surtaxes as well as to extend fiscal exemptions for capable and worthy students ; A.M.G. - F.T.T. Gazette — Vol. VI, No. 20 — 21 July 1953 317 NOW, THEREFORE, I, SIR JOHN WINTERTON, KCMG, CB, CBE, Major General, Zone Commander, ORDER: ARTICLE I INCREASE OF THE STATE CONTRIBUTION IN FAVOUR OF THE UNIVERSITY OF TRIESTE The amount of the State contribution for the maintenance of the University of Trieste, formerly increased by Order No. 453, dated 2 September 1947, is hereby increased up to 45 million Lire per half-year commencing from the financial period 1 January-30 June 1953. ARTICLE II CONTRIBUTIONS TO „OPERA UNIVERSITARIA“ 15% of the total amount of all University taxes, excluding surtaxes, and of the integrative contributions shall be destined by the University to „Opera Universitaria“ to augment collective and individual assistance to students. The University’s Administrative Council may further determine, year by year in relation to the actual needs, to devolve part of the State contribution mentioned sub Article I to „Opera Universitaria. “ ARTICLE III REDUCTION OF AN EXEMPTION FROM TAXES IN FAVOUR OF WORTHY STUDENTS Students in unwealthy economic conditions who, however, are capable and worthy, shall be dispensed from payment of taxes, surtaxes and contributions of all kinds by a resolution of the Administrative Council as follows : a) as to matriculation and inscription to the first year of the University course, whenever they have obtained, without repeating any exam, an average of seven tenths of those marks in those examinations taken to attain the secondary-studies-degree required for said matriculation ; b) as to inscription to years subsequent to the first : entirely if they have passed all exams of the studies plan suggested by the Faculty, haying obtained an average of nine tenths of the marks with not less than eight tenths for each of said exams and of seven tenths in not more than one exam ; c) as to the doctor’s degree or diploma, entirely or by one half of the surtax and contributions on the basis of the results of the exams of the last year’s course passed as indicated sub letter b) ; d) as to the doctor’s degree or diploma if, in addition to having obtained partial or total dispensation from payment of the surtax and contributions for the doctor’s degree or diploma examination referred to in letter c) above, they have passed such examination with a mark not lower than nine tenths. The Administrative Council may, having heard the Academic Senate, allow exceptional derogations of the minimum marks established in the foregoing paragraph in relation to particular difficulties concerning the studies-plan of single scientific Faculties. SUPPLEMENTARY CONTRIBUTION DUE BY STUDENTS IN WEALTHY ECONOMIC CONDITIONS By resolution of the Administrative Council, students belonging to families having a yearly total income exceeding three million Lire shall be subjected to a supplementary contribution, to be destined to „Opera Universitaria“, at the rate of 30% of the annual inscription tax. The ascertainment concerning the family’s economic condition shall be made in terms of the second paragraph of Article V below. ARTICLE V ASCERTAINMENT OF STUDENTS’ ECONOMIC CONDITIONS The condition of unwealthy family, mentioned sub Article III, shall be determined on the basis of the total yearly income in relation to the family-charges and to the actual financial burden which the family concerned has to bear for the student’s university-life. The ascertainment of the above condition shall be made by the University Administration with the assistance of „Opera Universitaria“ and through all means at its disposal and, further, by requesting the necessary information from the State Financial Administration. The dispensation from the taxes, surtaxes and contributions, contemplated sub Article III above, shall be granted neither to those students on whom a disciplinary punishment heavier than reprimand („ammonizione“) has been inflicted in the course of the year, nor to those who are in the condition of „extra cursum“ nor, finally, to those who, having already a doctor’s degree or a diploma, retake or have retaken inscription to attain another doctor’s degree or diploma. Said dispensation, however, shall be granted to students of Perfecting or Specialization Schools or of Schools having special aims. ARTICLE VI EXEMPTIONS FOR STUDENTS WHO ARE WAR INVALIDS OR ORPHANS Students who are war-orphans, including orphans of persons fallen in the Liberation War, as well as students orphans of persons who died for reasons of service or work, shall be dispensed, by a resolution of the Administrative Council, from payment of taxes, surtaxes and contributions provided, however, they are not unworthy in their proficiency and conduct and provided they are in an unwealthy economic condition. Under the same conditions there shall likewise be dispensed from payment of taxes, surtaxes and contributions, those students who are war maimed or invalids, including maimed and invalids from the Liberation War, as well as students who are maimed or invalids for reasons of service or work. Students of foreign citizenship belonging to families residing abroad who are availing themselves of scholarships set up by the State, by Italian Bodies or, upon opinion of the University’s Administrative Council, even by other Bodies, as well as students of Italian citizenship whose families have emigrated and reside abroad permanently, shall be exempted from payment of one half of all taxes, surtaxes and contributions. The benefit provided for by the second paragraph of this Article shall not be acknow- . ledged in favour of any students being in the condition of „repeater“ or of „extra cursum“, or having received, in the course, of the year, a disciplinary punishment heavier than reprimand. AMOUNT OF TAXES AND SURTAXES The University taxes and surtaxes shall be adjusted, commencing from the Academic Year 1952-1953, at the following rates : Academic Year 52/53 Academic Year from 53-54 onwards Matriculation tax 4.000 5.000 Annual Inscription Tax 14.000 18.000 Doctor’s degree or diploma tax 4.000 6.000 Annual surtax for proficiency examinations .. 6.000 7.000 Surtax for doctor’s degree or diploma examina- tions 2.000 3.000 The annual tax for „extra cursum“ students, requesting recognition of their status of students, shall be of 5.000 Lire for the first two „extra cursum“ years and shall be increased by 30% of said amount for each subsequent year ; the amount of surtax for repetition of proficiency and of doctor’s degree or diploma examinations is hereby fixed at the rate of 500 Lire for each proficiency examination and of 1.000 lire for the doctor’s degree or diploma examination. Those persons obtaining Specialization or Perfecting diplomas from the University shall pay the diploma-tax of 6.000 Lire in addition to payment of the taxes and surtaxes as established for their course of studies by the University Statutes. ARTICLE VIII INTEGRATIVE CONTRIBUTIONS The Administrative Council may impose, during the first three years’ period from the date of application of this Order, in addition to the taxes and surtaxes indicated in Article VII above, a single integrative contribution ; any other contribution in whatsoever way established shall be considered cancelled except as provided for by Article X below. The fourth paragraph of art. 152 of the Consolidated Text of the Laws on Superior Instruction, as approved by R.D. 31 August 1933, No. 1592, is hereby repealed. ARTICLE IX DOCTOR’S DEGREE TAXES The doctor’s degree or diploma taxes referred to in Article VII above shall be devolved to the State Treasury ; the destination of the surtaxes for proficiency and doctor’s degree for diploma examinations, including those of Specialization or Perfecting Schools and including surtaxes for repetition of exams, shall be governed by the provisions contained in the Consolidated Text of Laws on Superior Instruction ; the remaining taxes and the integrative contribution indicated sub Article VIII shall be devolved to the University. All taxes, surtaxes and contributions shall be paid directly to the University with the exception of State taxes. CONTRIBUTIONS FOR LIBRARIES AND SCIENTIFIC INSTITUTES Students may be required to pay special contributions for Libraries and for any Scientific Institute, such contributions being destined for laboratory, exercise and heating expenses. The amount of the contributions set forth in the foregoing paragraph shall be established, pi ior to the beginning of the Academic Year, by the Administrative Council on proposal of the Academic Senate, after hearing the Faculties and Schools constituting the University. The contributions shall be contained within the limits of the teaching exigencies in relation to the actual relative burden sustained by the University and cannot be increased in the course of the Academic Year. Contributions destined for laboratory and exercise expenses shall be devolved entirely to those Institutes providing for the single exercises. The University shall be allowed to request contributions up to the amount of 1.000 Lire for each regular and „Extra cursum“ student for the assistance and sporting activities of the students’ representative organizations. ARTICLE XI OPINION OF THE STUDENTS’ REPRESENTATIVE BODY As for the amount of the ccnti ibuticns referred to in Aiticle VIII and in the first paragraph of Article X, the Administrative Council shall hear the opinion of the students’ representative Body, the latter being the legal representative of the students’ organization recognized by the University. ARTICLE XII RATE OF SECRETARIATE FEES The rate of the Secretariate fees due by students for particular services rendered to them by the personnel in charge of the University instruction services, as well as the destination of the relative proceeds, shall be determined by a following Order. ARTICLE XIII EFFECTIVE DATE This Order shall become effective on the date« it is signed by me and, pursuant to the administrative instructions already issued, shall be operative from 1 November 1952 except as provided for in Article I hereof. WINTERTON Major General Ref. : LD/A/53/58 Zone Commander Order No. 99 WHEREAS it is deemed advisable to increase the amount of family allowances and of the pertinent rate of contribution in the Agriculture Section of the „Cassa unicail for family allowances, in that part of the Free Territory of Trieste administered by the British-XJnited States Forces, NOW, THEREFORE, I, SIR JOHN WINTERTON, KO MG, CB, CBE, Major General, Zone Commander, ORDER: ARTICLE I Section 1. •— With effect from 1 July 1952, the family allowances and the pertinent contributions of the Agriculture Section of the „Cassa unica“ for family allowances shall be increased according to the rates set forth in Table ,,B“ annexed to this Order. Section 2. -— The amount of family allowances and of the pertinent rate of contributions set forth, in respect of employees, in Table ,,B“ annexed to this Order, shall be inclusive of family allowances for „caropane“ and of the pertinent contributions provided for by Order No. 347, dated 28 September 1948, and subsequent amendments thereto. ARTICLE II Section 1. — Family allowances increased according to the amount established in the annexed Table ,,B“ for workers who are not qualified as employees shall be paid, for the year 1952, for a number of days equal to half of those assigned for same year to each individual head-of-family worker. Section 2. — The contribution set forth in the annexed Table ,,B“ in respect of those workers who are not qualified as employees shall be determined, for same year 1952, by applying an additional amount of 10.50 Lire to the contribution for family allowances set forth by Order No. 95, dated 22 May 1952, for each working day ascertained for same year in respect of agricultural employers for the aforesaid workers. WINTERTON Major General Ref. : LD/A/53/99 Zone Commander FAMILY ALLOWANCES AND RELATIVE CONTRIBUTIONS FOR AGRICULTURAL WORKERS TABLE ,,B A) DAILY BENEFITS To be paid : 1) to employees, workers with fixed salaries under a yearly contract and similar categories and to groups of workers („compartecipanti collettivi“), at the rate of 26 days per month ; 2) to workers with fixed salaries engaged or not in „colture agrarie“ under a contract lasting less than one year and similar categories, according to the number of days obtained by multiplying the number of months of duration of their contract by 26 ; 3) to „obbligati“ or labourers with fixed wages engaged or not in „colture agrarie“, according to the yearly number of working days allotted by contract ; 4) to „avventizi“ or day workers engaged or not in „colture agrarie“, and to individual workers, according to the total number of days of presumed occupation annually ascertained or ascertainable, in their respect, in each Province, in terms of arts. 4 and 5 of R.D. 24 September 1940, No. 1949, and according to the division to be made amongst the four sub-categories of „permanent, habitual, occasional and exceptional workers“ on the basis of the principles established by the Provincial Commission referred to in art. 5 of above mentioned R.D. and subsequent amendments thereto.
