La Editorial« Libraria, Triesto - 1948 ALLIED MILITARY GOVERNMENT British - United States Zone-Free Territory of Trieste Order No. 297 DECLARATION OF PUBLIC UTILITY AND OF URGENT AND UNDELAYABLE NECESSITY OF EXPROPRIATION OF CERTAIN LANDS AT MUGGIA WHEREAS the expropriation of certain lands at Muggia, in that Zone of the Free Territory of Trieste administered by the British-United States Forces, is deemed to be of public utility and of urgent and undelayable necessity for the purpose of the construction of eight popular houses ; and WHEREAS the project for the construction of the said houses, submitted by the „Genio Civile“ has been approved by the Allied Military Government . NOW, THEREFORE, I, RIDGEÚY GAITHER, Brigadier General, U. S. Army, Director General, Civil Affairs, ORDER: ARTICLE I DECLARATION OF PUBLIC UTILITY AND OF URGENT AND UNDELAYABLE NECESSITY a) By virtue of this Order the expropriation of certain lands in the district of Muggia, necessary for the construction of eight popular houses according to the project submitted by „Genio Civile“ and approved by the Allied Military Government, is hereby declared to be of public utility and of urgent and undelayable necessity in accordance with Art. 71 of the Law 25 June 1865, No. 2359. b) The aforementioned declaration shall have full effect in accordance with the laws in force. ARTICLE II EFFECTS AND DEPOSIT OF PROJECT The project, identifying the lands, together with the drawings and maps relating to the construction mentioned in Article 1 hereof shall be deposited at the „Ufficio Espropri“ of „Genio Civile“, Trieste, and may be freely inspected by all persons concerned. They shall bear the indication „Relative to Order 297“ and shall.be a constituent part of this Order. EFFECTIVE DATE This Order shall come into force on the date it is signed by me. Army Director General, Civil Affairs Order No. 307 PROVISIONS RELATING TO THE HUNTING SEASON OF 1948-1949 WHEREAS it is considered advisable and necessary to extend the validity of Order No. 431 (201 A) dated 31 July 1947, which provides for the control and regulation of hunting in that part of the Free Territory of Trieste administered by the British-United States Forces (hereinafter referred to as the „Zone“) ; NOW, THEREFORE, I, RIDGELY GAITHER, Brigadier General, U. S. Army, Director General, Civil Affairs, ORDER: ARTICLE I EXTENSION OF VALIDITY OF ORDER No. 431 (201 A) TO THE HUNTING SEASON 1948-1949 AND AMENDMENTS THERETO Section 1. ■—• With the exceptions, amendments and supplements as set forth in the following Sections of this Article, the provisions of Order No. 431 (201 A) dated 31 July 1947, entitled, provisions relating to the hunting season of 1947 - 1948 (hereinafter referred to as the „said Order“) published in the Allied Military Government Gazette No. 24, dated 11 August 1947, shall be extended in the Zone to the hunting season 1948 - 1949. Army Director General, Civil Affairs Order No. 325 AMENDMENT TO LAW No. 112 OF 10 JANUARY 1935 AND OTHER PROVISIONS RELATING TO THE ISSUING OF LABOUR BOOKS WHEREAS it is deemed necessary and advisable to amend the Law No. 112 of 10 January 1935 relating to the issuing of Labour Books and to make certain provisions in view of the particular local situation of unemployment within that part of the Free Territory of Trieste administered by the British- United States Forces '(hereinafter referred to as the „Zone“), NOW, THEREFORE, 1, RIDGELY GAITHER, Brigadier General U. S. Army, Director General, Civil Affairs, ORDER: ARTICLE I AMENDMENT TO ARTICLE 2 OF THE LAW No. 112 OF 10 JANUARY 1935 Section 1. — The words „che li rilasceranno ai lavoratori dimoranti nel Comune,’, occurring in para 1, Artide 2 of the Law No. 112 dated 10 January 1935, shall be and hereby are deleted and substituted by the following : „che li rilasceranno ai lavoratori cittadini italiani legalmente iscritti nel registro della popolazione stabile del Comune, che ne facciano richiesta“ (who shall issue them, upon request, to workers that are Italian citizens and are lawfully registered in the permanent population register of a Commune). Section 2. ■—■ The last para of Article 2 of the aforesaid Law shall be and hereby is deleted and substituted by the following : „Per i lavoratori non cittadini italiani legalmente iscritti nel registro della popolazione stabile di uno dei Comuni della Zona, il libretto sarà rilasciato dall’ Ispettorato del Lavoro su richiesta del datore di lavoro presso il quale essi prestano o intendono prestare la propria opera, salva l’approvazione del Capo del Dipartimento del Lavoro“. (Workers that are not Italian citizens but are lawfully registered in the permanent population register of one of the Commu- nes of the Zone, shall be given the Labour Book by the Labour Inspectorate, on the request of their present or prospective employer, subject to the approval of the Chief, Department of Labour). ARTICLE II REGISTRATION WITH THE PLACEMENT OFFICE Unemployed persons shall be registered with the Placement Office (Ufficio Collocamento) of the Labour Office, only if in the lawful possession of a Labour Book. ARTICLE III PERSONS UNQUALIFIED FOR LABOUR BOOKS Ail persons who do not qualify for Labour Books under Article 2 of the Law No. 112 as amended at present within the Zone, shall not be permitted to continue in their employment and shall not be registered with the Placement Office as unemployed persons. Under exceptional circumstances a special permit to continue the employment for a limited period of time may be granted, upon request, by the Department of Labour. ARTICLE IV PENALTY Any person making false statements in order to obtain a Labour Book or obtaining it while not entitled thereto in accordance with the provisions of this Order, or otherwise violating any of the provisions of this Order, shall be guilty of an offence and, upon conviction by a Court, be punished by imprisonment (reclusione) up to one year or to a fine (multa) up to 100.000.-—- lire, or both as such Court may determine. ARTICLE V EFFECTIVE DATE This Order shall become effective on the tenth day following its publication in the Official Gazette. Trieste, this 14th day of August 1948. Army Director General, Civil Affairs Order No. 238 EXAMINATIONS FOR PROCURATORS LEGALE FOR 1948 WHEREAS it is deemed advisable to make provisions for examinations for qualifying as Procuratore Legale for the year 1948 in the British-United States Zone of the Free Territory of Trieste (hereinafter referred to as the „Zone“) ; NOW, THEREFORE, I, RIDGELY GAITHER, Brigadier General, U. S. Army, Director General, Civil Affairs, ORDER: ARTICLE I ANNOUNCEMENT OF EXAMINATIONS AND DATES OF WRITTEN TESTS Section 1. ■— Examinations for qualifying as Procuratore Legale, Court of Appeal of Trieste, are hereby announced open to all qualified candidates residing in the Zone. Section 2. •—■ Written tests will be held-at 9 o’clock on the following dates at such place in Trieste as the Examining Commission shall appoint: 28 October 1948 •—• Substantive Civil and Administrative Law 29 October 1948 — Civil and Penal Procedure. ARTICLE II APPLICATIONS FOR ADMISSION Section 1. ■— Applications for admission, addressed to the Examining Commission, Court of Appeal, Trieste, must be lodged not later than 31 August 1948. Section 2. ■— Admission tax will be Lire 1600.—. ARTICLE III CONFIRMATION OR MODIFICATION OF PRECEDING PROVISIONS Section 1. ■— The provisions of Order No. 65 dated 24 January 1946, shall remain in effect as regards the present examinations in so far as they are not incompatible with this Order. Section 2. — The words „effective date of this Order“ contained in Order No. 65, Articles IV and V, shall be substituted by „31 August 1948“. Section 3. — The provisions of Article I Sections 1 and 3 of Order No. 70 dated 13 February 1946, shall remain in effect as regards the examinations provided for by the present Order. Army Director General, Civil Affairs Order No. 248 DECLARATION OF PUBLIC UTILITY — TIMAVO LAND RECLAMATION WHEREAS, the construction of a Fishing ground on the south side of Timavo river, near the river-mouth, Commune of Euino, is considered to he of urgent necessity and in the 'public interest in that Zone of the Free Territory of Trieste administered by the British-United States Forces ; and WHEREAS, the project for said reclamation work requested by the „Consorzio Territorial per la Tutela della Pesca“ has been prepared by the „Genio Civileand approved by Allied Military Government on 6 February 1948, NOW, THEREFORE, I, RIEGELY GAITHER, Brigadier General, U. S. Army, Director General, Civil Affairs, ARTICLE I DECLARATION OF PUBLIC UTILITY Section 1. —- By the terms of the present Order the reclamation of land for a fisheries project on the south of the Timavo river, Commune of Duino, is hereby declared to be of urgent necessity and of public utility and interest. Section 2. ■—■ The said land is specifically delineated on map „Annex A“ referred to in Article II herein, and covers that ground appearing in Department of Public Works project No. AMG FTT 630, as proposed by the „Consorzio Territoriale per la Tutela della Pesca“ on 20 June 1947, and approved by Allied Military Government. Section 3. — The above declaration shall be given and shall have all the effects of laws in force on 8 September 1943. ARTICLE II EFFECT AND DEPOSIT OF THE ANNEXED MAP Map „Annex A“ mentioned in the foregoing Article shall be and is hereby made a part of this Order. It shall be deposited in the Office of the Department of Public Works, Allied Military Government, Trieste, and in the Office of the Genio Civile and the same may be freely examined by all persons concerned. ARTICLE III EFFECTIVE DATE This Order shall become effective on the date it is signed by me. Dated at Trieste, this 18th day of August, 1948. RIDGELY GAITHER Brigadier General, U. S. Army Director General, Civil Affairs Order No. 327 ENGAGEMENT, DISMISSAL AND REGISTRATION OF WORKERS WHEREAS, it is necessary to clarify and amend General Order No. 72 of Allied Military Government relating to engagement, dismissal and registration of workers in the British-United States Zone of the Free Territory of Trieste ; NOW, THEREFORE, I, RIDGELY GAITHER, Brigadier General, U. S. Army, Director General, Civil Affairs, ARTICLE I Article XIII of General Order No. 72, dated 4 November, 1946, is hereby amended to read as follows : The provisions of this Order shall apply to all employees and workers employed or to be employed in all private firms, public bodies and agencies including all offices, departments and agencies of local government, and parastatal bodies, excepting therefrom persons in a ,,di ruolo“ status.
