A., Trieste - 1952 ALLIED MILITARY GOVERNMENT British - United States Zone-Free Territory of Trieste Order No. 165 RE ORGANIZATION OF ALLIED MILITARY GOVERNMENT WHEREAS it is deemed necessary to re-adjust the organization of Allied Military Government (AMG) as established by Order No. 308/1948, as amended by Order No. 398/1948, Order No. 51/1949, Order No. 229/1950 and Order No. 6/1951, in that part of the Free Territory of Trieste administered by the British-United States Forces (hereinafter referred to as the „Zone“), NOW, THEREFORE, I, SIR JOHN WINTERTON, KCMG, OB, CBE, Major General, Zone Commander, ORDER: ARTICLE I PRIOR ORDERS Section 1. — Order No. 308/1948, as amended by Order No. 398/1948, Order No. 51/1949, Order No. 229/1950 and Order No. 6/1951, as well as any other provision of existing laws and Orders which are inconsistent with any provision of this Order, are hereby repealed. Section 2. — Nothing contained in this Order shall be construed to affect the validity of any action taken or done by any Directorate, Department, Section or Office of Allied Military Government prior to the effective date of this Order. Whenever the title „Director General“ or „Director General, Civil Affairs“ appears in any existing Orders or legislation it shall be read hereafter to mean the Zone Commander. Whenever the phrase „with the advice and consent of the Director General“ appears it shall be read hereafter to mean “ with the prior consent of the Zone Commander“. ARTICLE II ORGANIZATION OF ALLIED MILITARY GOVERNMENT Allied Military Government (AMG) will consist of the Office of the Zone Commander and of such Directorates, Departments, Sections and Offices as are assigned by this Order or by Orders or administrative instructions subsequently issued. ARTICLE III OFFICE OF THE ZONE COMMANDER Sec on 1. — The Office of the Zone Commander will include : a) A.M.G. Chief of Staff b) Comptroller c) Public Information Officer d) Real. Estate Officer. Section 2. — The A.M.G. Chief of Staff will perform such staff functions as the Zone Commander may direct. Section 3. — The Comptroller will : a) Establish and supervise appropriate budgetary and fiscal control over accounts relating to funds and property for which AMG ÿs accountable and/or responsible. b) Perform all auditing functions. c) Provide for the payment of current AMO. expenses for wages, rents, maintenance, etc. d) Provide for settlement of claims against AMG. e) Perform such other duties as may be assigned to him by the Zone. Commander. Section i. —, The Public Information Officer will have supervision and control of all publications and films published or circulated within the Zone and will operate and control Allied Military Government broadcasting stations. He will also, be responsible for alii piçss releases, public announcements etc. made by Allied Military Government or any of its officials, Directorates, Departments or Offices. He will have, such other duties as may be assigned to him by the Zone Commander. Section 5. — The Real Estate officer will be chairman of the Requisition Board and wil be responsible for all housing and construction, programs, for British and United States troops ARTICLE IV SENIOR DIRECTOR OF ADMINISTRATION - SPECIAL DIRECTOR FOR SECURITY -DIRECTOR OF LEGAL AFFAIRS Section 1. — The activities of. the. Directorate of. Interior and the. Directorate of Finance and Economics will be immediately directed and coordinated by a Senior Director of: Administration. He will ensure that these Directorates are carrying out the policies and directives, of the Zone Commander. He will keep the Zone Commander appropriately informed of all the activities of the Directorates under his direction. He will prepare, or have prepared, and transmit to the Zone Commander drafts of all legislation applicable to his functions. Section 2. — The activities of the Directorate of Public Safety, the Directorate of the Port, Office of Post, and Telecommunications, Shipping Control Office, Military Permits Office, Displaced Persons Office, will be immediately directed and coordinated by a Special Director for Security. He will ensure that these Directorates and Offices are carrying out the policies and directives of the Zone Commander. He will prepare, or have prepared, and transmit to the Zone Commander drafts of all legislation applicable to his functions. Section 3. — The Chief Officer of the Directorate of Legal Affairs will be the Director of Legal Affairs who will be the chief legal adviser to the Zone Commander and will have supervision and control of the administration of justice through both military government courts and civil courts. He will have and exercise all the powers, duties and functions, as of a Minister of Grace and Justice under the laws applicable within the Zone. He will be responsible for legal form of all legislation submitted for promulgation in the Zone. He will also be. responsible for the publication of the Official Gazette. ARTICLE Y DIRECTORATE OF INTERIOR Section 1. — The chief officer of the Directorate of Interior will be the Director of Interior who will have supervision of all matters pertaining to the internal administration of the Zone as established under Order No. 259/1948. He will also have and exercise all of the powers, duties and functions of à Minister òf Interior under the laws applicable within thé Zone with the exception of those relating to Public Security and as otherwise herein assigned to other Directorates, Departments and Offices. He will also immediately direct the activities of the following Departments and Offices : Department of Labour Department of Social Assistance Office of Public Health Office of Education Office of Census and Survey Fire Service. Section 2. — The chief officer of the Department of Labour will be Chief, Department of Labour. He will have such powers* duties and functions as will be granted by the Director of Interior with the advice and consent of the Senior Director of Administration. Section 3. — The chief officer of the Department of Social Assistance will be Chief, Department of Social Assistance. He will have stich powers, duties and functions as will be granted by the Director of Interior with the advice and consent Of the Senior Director of Administration. In particular he will supervise, direct and control all matters pertaining to public assistance, social insurance and child welfare. Section 4. — The chief officers of the Offices of Public Health, Education, Census and Survey as well as of Fire Service will have such powers, duties and functions as will be granted by the Director of Interior with the advice and consent of the Senior Director of Administration. ARTICLE VI DIRECTORATE OF FINANCE AND ECONOMICS Section 1. — The dhief OffiOer of the Directorate of Finance and Economics wiil be Director Of Fiiiance and Economics. Hë is charged with the supervision* direction and control of all matters affecting the economic development of the Zone, governmental finance and all technical agencies which are directly responsible to the central government. He will be responsible fOr the ptèpdration of the budget. He will aiso have Und exërëise all of the powers duties and functions of à Minister of FinUncë under the laws applicable within thè Zone. He will immediately direct the activities of the following Departments and Offices : Department of Commerce Department of Production Department of Finance (including Finance Guards and Customs) Department of Transportation Department of Publie Works and Utilities Office of Agriculture and Fisheries Loans Section. Section 2. — The chief officer of the Department of Commerce will be Chief, Department of Commerce. He will have and exercise such powers, duties and functions as will be granted by the Director of Finance and Economics with the advice and consent of the Senior Director of Admi nistration. Section 3. — The chief officer of the Department of Production will be Chief, Department ox Production. He will have and exercise such powers, duties and functions as will be granted by the Director of Finance and Economics with the advice and consent of the Senioi Director of Administration. Section 4. — The chief officer of the Department of Finance, will be Chief, Department of Finance. In addition to such powers, duties and functions as will be granted by the Director of Finance and Economics with the advice and consent of the Senior Director of Administration, he will have and exercise the powers, duties and functions of a Minister of the Treasury under the laws applicable within the Zone, including the control of Finance Guards and Customs. Section 5. — The chief officer of the Department of Transportation will be Chief, Department of Transportation. In addition to such powers, duties and functions as will be granted by the Director of Finance and Economics with the advice and consent of the Senior Director of Administration, he will have and exercise the powers, duties and functions of a Minister of Transportation under the laws applicable within the Zone. Section 6. — The chief officer of the Department of Public Works and Utilities will be Chief, Department of Public Works and Utilities. In addition to such powers, duties and functions as will be granted by the Director of Finance & Economics with the advice and consent of the Senior Director of Administration, he will have and exercise the powers, duties and functions of a Minister of Public Works under the laws applicable within the Zone. Section 7. — The chief officers of the Office of Agriculture and Fisheries and of the Loan Section shall have such powers, duties and functions as shall be granted by the Director of Finance & Economics with the advice and consent of the Senior Director of Administration. ARTICLE VII OFFICES DEPENDING UPON THE SPECIAL DIRECTOR FOR SECURITY Section 1. — The chief officer of the Directorate of Public Safety will be the Director of Public Safety. He will be charged with the immediate responsibility for all matters affecting public safety in the Zone. He will also be the Inspector General of the Venezia Giulia Police Force. Section 2. — The chief officer of the Directorate of the Port will be the Director of the Port. He will exercise the powers, duties and functions of the Director of the Port of Trieste as provided in Order No. 442/1947, as amended by Order No. 249/1948. Section 3 — The chief officer of the Office of Post and Telecommunications will be Chief, Post and Telecommunications who will have and exercise all of the powers, duties and functions of a Minister of Posts and Telegraphs under the laws applicable within the Zone. Section 4. — The chief officer of the Shipping Control Office will be the Shipping Control Officer. He will exercise such control of movement of all goods into and out of the Zone as the Zone Commander may direct. Section 5. — The chief officer of the Military Permits Office will be the Military Permits Officer. He will control the issue of travel documents for entry and exit from the Zone in accordance with the policies of the Zone Commander. Section 6. — The chief officer of the Displaced Persons Office will be the Displaced Persons Officer. He will be responsible for all matters in connection with Displaced Persons.
