Army Ref. : LDIAf51/126 Director General, Civil Affairs Order No. 140 DETERMINATION OF THE RATE OF CONTRIBUTION DUE FOR THE YEAR 1950 IN FAV OUR OF PATRONAGE AND SOCIAL ASSISTANCE OFFICES WHEREAS it is deemed necessary to determine for the year 1950 the quota-share of contributions due in favour of Patronage and Social Assistance Offices in terms of Article VII, Section 2, of Order No. 77, dated 27 December 1947, in that part of the Free Territory of Trieste administered by the British-United States Forces, NOW, THEREFORE, I, JOHN L. WHITELAW, Brigadier General U.S. Army, Elector General, Civil Affairs, ORDER: ARTICLE I RATE OF THE QUOTA - SHARE Section 1. — The quota-share provided for by Ait’c-le VII, Section 2, of Gibtr No. 77 dated 27 December 1947, is fixed for the year 1950 at the rate of 0,15% of the contiibutions collected for the period 1 January to 31 December 1950. Section 2. — The funds deriving from the allocation of the quota-share of contributions referred to in the preceding Section shall be paid by the Institutes exercising the different classes of social insirance, after the closing of the financial year 1950 in the manner provided for by Article VIII, Section 1, of Order No. 77 dated 27 December 1947 as amemded by Article I of Order No. 80 dated 14 April 1949. Army Ref.: LDIAI51fll2 Director General Civil Affdrs Order No. 141 PROVISIONS FOR THE CARRYING OUT AND FINANCING OF THE GENERAL CENSUS OF THE POPOLATION AND OF THE GENERAL CENSUS OF INDUSTRY AND COMMERCE WHEREAS it is deemed advisable to make provisions for the carrying out and financing of the General Census of the Population and of the General Census of Industry and Commerce, in that part of the Free Territory of Trieste administered by the British- United States Forces, NOW, THEREFORE, I, JOHN L. WHITELAW Brigadier General U.S. Army, Director General, Civil Affairs, ORDER: ARTICLE I On 4 and 5 November 1951, the General Census of the Population and the General Census of Industry and Commerce, respectively, shall take place in each Commune. At the same time as the General Census of the Population a survey of the dwellings shall be made. ARTICLE II The census of the population shall cover in each Comn une, the following : a) the resident population, that shall be considered legal until the next census, and the present or ,,de facto“ population ; b) the number of families and „convivenze“ and their respective composition ; c) the sex, civil status, date and Commune of birth, Commune of habitual residence and grade of education of each eensused person, be he/she present or temporarily absent on the date of the census. There shall also be ascertained : 1) for those temporarily absent, the locality where they are and the date since which they have been absent from the family or „convivenza“ ; and 2) for foreigners, their citizenship ; d) the profession, art or trade performed by each person, his/her position within the profession, and the kind of activity *of the concern or body where each person is employed at the date of the census, or previously, if unemployed ; e) for „eonduttori“ of agricultural, zootechnical or forestal concerns, the extent and type of the tenancy („conduzione“). ARTICLE 111 The General Census of Industry and Commerce shall cover in each Commune : a) the number of the firms, plants, factories, workshops, mines, „esercizi“, shops, both public and private, even if temporarily inactive on the date of the census, and which perform their activity in industry, transportation and communications, credit and insurance, and services ; b) The juridical nature of the each unit and the economic activity performed ; c) for all units : the personnel employed ; the motors installed ; the electric energy generators ; the means of transportation in force on the date of the census ; the amount of the gross and net compensations paid to the personnel during the year 1950 ; d) for industral plants, „esercizi“, factories, workshops and for mines, regardless o^ their size the quality and quantity of the products and by-products manufactured during the year 1950. ARTICLE XV The survey of the dwellings shall include data and information relating to the nun her of persons, type of dwelling, habitability, number of rooms („stanze e vani“) existence nnd conditions of the kitchen facilities, electricity, gas heating, hygienic-sanitary, and potable water installations, and title for the use of the premises. ARTICLE V The information that will be the subject of the statistical surveys provided for in Article I, shall be collected by using sheets and questionnaires (in conformity with the forms which will be established by the rules for execution) distributed and collected by the Communes. The forms concerning the General Census of the population shall be filled in duplicate, of which one copy shall be used for the immediate general revision of the population registers of the Communes, which must perform such revision by 31 December 1952. ARTICLE VI The Census & Survey Office, Allied Military Government, is hereby authorized to issue regulations concerning the procedure for the execution of this Order, after hearing the Commission provided for in the following Article. The operations provided by Article I shall be performed by the Zone Census Office according to the directives of the Census and Survey Office, Allied Military Government, and the expense shall be completely to the burden of Allied Military Government. ARTICLE VII In order to supervise the performance of the statistical operations and surveys and the tabulation of the results, there shall be constituted, by Administrative Order, a Supervisory Commission composed as follows : ; the Chief, Census & Survey Office a representative of the Department of Interior ; a representative of the Department of Finance ; the Chief of the Zone Census Office ; a professor of Statistics at the University of Trieste ; the representative of employers ; two representatives of employers : two representatives of workers. An official designated by the Zone President shall act as Secretary of the Commission. The Commission shall hold office for the entire period of performance of the statistical surveys and tabulations. In each Commune a Communal Supervisory Commission shall be constituted by vile Mayor. The Commission shall be presided over by the Mayor or by a delegate of his and shall be constituted by a minimum of six and a maximum of fourteen citizens, selected from among those persons who, owing to their skill or activities performed, may secure a regular performance of the statistical surveys. ARTICLE IX Heads of families and „convivenze“, owners, „conduttori“, managers of firms, concerns and „esercizi“ subject to the census and, in general, those who, though obliged, do net supply the information required, or supply incomplete or knowingly false information, shall be subject to a fine („ammenda“) up to 20.000 Lire, which may be increased up to 200.000 Lire in case of recidivism, without any prejudice to the provisions of.the Penal Code. ARTICLE X Tne information and da a collected during the statistical surveys provided for in Article I, shall be bound to official secrecy and shall not be communicated to either private individuals or organs of the public administration, except by Allied Military Government in such summarized form as they may determine, and without any individual reference. ARTICLE XI The correspondence and the printed matter concerning the census, forwarded by the offices in charge of the performance of the statistical surveys as provided for in Article I, shall be postage-free and shall have free transportation on the State railways and on licensed lines („linee in concessione“). ARTICLE XII The special cards for the mechanical tabulation of the data, needed for the Census as provided in Article I, which might have to be imported from abroad shall be free of customs duties. ARTICLE XIII For the necessities in relation with the carrying out of the census provided for by Article 1 of this Order and for the duration of the relative works, the Zone Census Office may avail itself of the services of the employees, ,,di ruolo“ and „non di ruolo“, of other public administrations, to be assigned for work to that Office by order of the Zone President, in agreement with the Allied Military Government. For surveys of local nature, the Zone Census Office may also avail iiself, as a temporary assignment, also of the services of persons not belonging to the public administrations. The remunerations to be given to such persons shall be previously established by the Zone President, in agreement with the Allied Military Government. The work for the revision, and coding of the questionnaires shall be made by the Census and Survey Office, Allied Military Government. This Office shall avail itself of the personnel of public administrations, who shall be ordered for service with said Office by the Allied Military Government, in agreement with the Administrations concerned. ARTICLE XIV The Zone President, after hearing the Supervisory Commission provided for in Article VII, shall order the performance „ex officio“ (in terms of art. 91 of the Consolidated Text of the Communal and Provincial Law, approved by R.D. 3 March 1934, No. 383) of the operations omitted or performed irregularly and charge the Communal with the expenses concerning the new operations that have become necessary. Civil Affairs Order No. 142 TRANSIT AND STAY OF MERCANTILE SHIPS ALONG THE COASTS OF THE ZONE WHEREAS it is considered advisable to increase the fines („sanzioni pecunarieil) set forth in article io of the Law 16 June 1912, No. 612, containing provisions for the transit and stay of mercantile ships along the coasts of the State, in that part of the Free Territory of Trieste administered by the Britishh-United States Forces, NOW, THEREFORE, I, JOHN L. WHITELAW, Brigadier General U.A. Army, Director General, Civil Affairs, ORDER: ARTICLE 1 Article 10 of the Law 16 June 1912, No. 612, containing provisions for the transit and stay of mercantile ships along the coasts of the State, is hereby repealed and substituted by the following : „Any contravention of the provisions of this law shall be punished by a fine („ammenda“) „of from 5,000 up to 80.000 Lire against the ship’s captain. „Whenever it has been necessary to use force the amount of the fine shall be not less „than 50.000 Lire, and punishment by detention („arresto“) from one to twelve months shall „be imposed in addition against the captain.“ Ti:)s Order «hall becorre effective on the date of its publication in the Official Gazette. Director General, Civil Affairs Order No. 143 REGULARIZATION, FOR FISCAL PURPOSES, OF LIGHTERS MANUFACTURED IN THE ZONE,IN ITALY, OR IMPORTED FROM ABROAD WHEREAS it is deemed advisable to regularize, for fiscal purposes, the possession of lighters manufactured in the Zone, in Italy, or imported from abroad, in the part of the Free Territory of Trieste administered by the British-United States Forces (hereinafter referred to as the „Zone“), NOW, THEREFORE, I, JOHN L. WHITELAW, Brigadier General U.S. Army, Director General, Civil Affairs, ORDER: ARTICLE I Possessors of lighters (whether ignited by flint, pyrophorous paper, electricity or other n eons) manufactured in the Zone, in Italy, or imported from abroad, shall be permitted, as an exceptional measure, io regularize their position by paying, within six months from the effective date of this Order, only the fixed rate of duty established for such lighters.
